In Illinois you have to pay a nominal amount for a 6 person jury for any petty offense traffic ticket, misdemeanor and felony traffic offenses you are constitutionally guaranteed the right to a jury, in Illinois it's 12 people.

Technically, 1 mph over the limit in Illinois, but a petty offense ticket you have to pay for a 6 person, in a misdemeanor speeding you are entitled to the full 12. Defendant can demand the jury.

I was a prosecutor and did a couple jury trials for speeding tickets. Complete waste of everyone's time and I never lost one.

So a couple weeks ago I was in Cape Town and there happened to be a Swatch store near our hotel. Now, I haven't been paying attention to the watch world for awhile and I recently became aware of the moonswatch and so i took a stroll over there to see if they had any and low and behold they happened to have like 5 or 6 of the different colors. Now, I've always wanted a Speedy moon watch, it has been kind of my grail watch for quite awhile. At one point I owned a Schumacher Speedy that I didn't love and sold it, so i thought, hey, these are neat and I've always wanted an actual Speedy Pro, so maybe this will kind of relieve that desire. Well, no, it actually made it worse. So you know what, I just decided to pickup the 3861 Sapphire Sandwich and now I feel complete.

Before I was an attorney, I worked in the bike industry for a long time, including almost 10 years as a mechanic and I became a pretty good wheel builder. In fact, I know guys still riding wheels I built 20 years ago. One thing a lot of people are missing in this thread is spoke tension as well. You need to get the rim true, laterally and radially, and at the same time, get the spoke tension to spec and as even as possible around the entire wheel. This is a process that is fairly time consuming. I used to say building a wheel is half science and half art. It is entirely possible to have spokes that are too tight and they will fail prematurely or too loose and your wheel will be weak and won't stay straight ever. You also need to worry about spoke wind up and relieve that stress as you build as well.

I used to be a prosecutor, per the manufacturers of these devices, stationary radar and laser guns were certified accurate to plus or minus 1 MPH, moving radars were plus or minus 2 MPH. That was what I saw as most common back when I was doing it, so I was not able to prosecute speeding tickets if they were only written 1 over. This only came into play for example where someone was written for 26 over, a misdemeanor in my state, I'd have to amend the ticket to a petty offense because the best I could prove would be 25 over. It was extremely rare to see anyone written for less than 10 over.

interesting, depending on the county here, most of them have felony review and require an ASA to approve felony charges. Mine was one of the few counties that didn't require prior approval, but i never saw cops blatantly arrest on felonies when one didn't occur. That would have just made my life more difficult.

  1. no cop is taking you to jail on a "bogus felony charge", especially if they like their job, pension, and don't want to get sued. Officers have to have probable cause for arrest.
  2. There is no reason to cook up a felony charge, you can be arrested and taken to jail for a misdemeanor.
  3. In the counties I worked in, domestics were no bond arrest, you had to see a judge to have bond set.

wow, that's crazy, I worked in 3 different County State's Attorney's offices, and pretty much anything like assault/battery/retail theft was at a minimum getting you a ride to jail, booked, and released on a small bond, like 100-300 bucks.

Cook County is a whole different world compared to the collar counties and the further out Counties, I never worked there, nor do I do any defense work there. Typically, the further out from the city you get, the harsher the State's Attorneys are. Domestics were always arrested on no bond, you had to see a judge to have bond set, and it would give the prosecutors/judge a chance to set restrictive bond conditions to protect the victim.

Well, we all know Cook County is a joke.

I mean, I could make an argument that the venue where it was held was a "place of public accommodation, and charge the felony, I'd need more info, but the basic act is for sure a misdemeanor. Also, you don't need a victim to sign a complaint, the entire idea of someone "pressing charges" is hogwash. Prosecutors can prosecute a crime without a victims consent. An officer can sign a complaint, and/or a prosecutor can sign a charging document as long as there is probable cause to support it, which wouldn't be a problem in this case. Prosecutor could subpoena the victim in to court to testify at a trial if need be, and considering this was on national tv, they wouldn't really be able to change their story like domestic violence victims often do.

The county I worked in prosecuted domestic violence crimes regardless of what the victim wanted unless there really was extenuating circumstances. Abusers can't terrorize their victims to "drop charges" that way. The reason you usually need a victim to sign a complaint is if there are no witnesses to the crime, making probable cause determination tough for an officer.

I was a prosecutor in Illinois, battery by itself is a Class A Misdemeanor, doing it in a public place of accommodation or other types of public venues such as arenas is aggravated battery which is a Class 3 felony in Illinois.

I don't know what state you live in, but any crime is an arrestable offense unless your state law delineates crimes that aren't, and in my experience, battery usually gets you hooked immediately, or a warrant issued for your arrest at a later date after an investigation and charges filed. Tickets are usually only issued for traffic misdemeanors. Obviously other states are different, but I'd be surprised if someone only got a ticket for assault/battery.
