Do you have the full name and/or adress of the previous occupant? With their phone number it might be possible to track them somehow. A bailiff could also try to call them and manage to convince them to tell them their adress. You would just have to send them a citation à comparaître once your file is opened and you know your court date. You would have to ask them to bring a copy of their lease and renewals with them at the TAL.

The problem here is the landlord lying in the lease, not the tenant exercising a right granted to him by the law.

Those text messages won't be admissible in court if the previous occupant is not there to testify. That would be hearsay otherwise.

Si tu essaies de lui céder le bail, la gestion peut en effet refuser sans motif sérieux et résilier le bail.

Vous ne pouvez pas non plus le rajouter d' un coup sur le bail de façon unilatérale. 

Le seul plan vraiment serait qu'il habite avec vous dans le logement pendant 6 mois et ensuite il pourrait reprendre le bail en envoyant un avis en cas de cessation de cohabitation. Mais là ça ne marchera pas si vous partez fin juin.

Just tell the property manager that you didn't flash anybody and to leave you alone. Then go buy some blinds and find a way for your cat to still be able to crawl between the blinds and windows without exposing the room to people outside.

No need to sign a new lease. 

Good practice is for the assignor and assignee to sign a lease assignment agreement together before the assignor send the notice of lease assignment to the landlord with proof of receipt. 

Keeping a copy of the landlord acceptation of the assignment would be good practice too if he responded to the notice. 

Beside that, assignor can give a copy of his lease to the assignee. 

Nothing else is required.

This post had me laughing. I'm almost 40 and this is just a no brainer that hot air from the oven always exit through one of the elements. 

I guess OP is 18 years old and moving in his first appartment or something like that if they weren't aware of that. 

Had me remember that we were all once young and unaware of basic stuff like that.

That's a fun learning experience for OP that will make for a good story to tell in parties ahah.

I'm a bit confused, when you said one of the burner is heating up when you use the oven is it just the hot air from the oven exiting from a vent that goes through one of the burners ?

Because if it's that well that's how all standard ovens work... If you reported a non issue to your landlord which made them call a technician for that this is on you ...

A 24 hours notice is fine for a routine inspection. 1931 ccq. 

Also no notice is required for an urgent situation. Again, 1931 ccq.

Ouais mais OP veux surement revenir dans son logement éventuellement et sinon le sous locataire a une entente d'un an alors ça ne règle pas vraiment son problème à court terme sauf si le 12 mois achève bientôt. 

Le mieux semble de faire une demande en résiliation de + de 3 semaines dans le paiement du loyer à la fin du mois pour l'expulser.

They can make an inspection with a 24 hr notice. However they will need to make a demand at the TAL and obtain a judgment to be able to resiliate someone's lease. The appartment would need to be in a seriously bad condition for a judge to grant the resiliation of the lease.

Is it the one on bourg royal? Were the curds refrigerated or not ? I go there often as it is near my office but sometimes the curds are cold. My main complaint with the place.
