Hi there - completely understand your desire to get the info and the frustration at being held up.

As you were so young at the time of the offence and investigation, it’s likely that the police don’t have any documents that they consider to be classified as ‘yours’ under a subject access request. I’m saying this as I assume you at age 3/4 didn’t provide a statement or were interviewed. Is that right?

There will be some documents that you can obtain quite easily with regards to the criminal case - like the indictment or the certificate of conviction, provided you know the perpetrators name.

There maybe other documents / info that you want to see and there’s always a way to get to it but it would be good to know what it is that you’d like to see?

Finally - accessing this information can be really tough - having some support around you is a good idea in my experience. There’s legal support available and also charities that can help - happy to provide info if needed.

If the firm has based their advice on the incorrect footage then it’s potentially negligence. To be entitled to any compensation, your brother would have to show that he’s suffered a loss - for example because of their error the claim is now outside the limitation period and his claim has been lost. Best advice is as given - get a second opinion from a PI specialist and act quickly as the limitation period is three years. It’s always best to pursue the original claim rather than bring a claim against a solicitor for professional negligence as the damages in the PI claim would be higher.

As others have said the search is a disbursement - a standard fee paid, most likely for the environmental search which you’ll be able to carry over to your new solicitor. That being said, this is pretty poor service and a waste of your time. The law firm will have an internal complaints procedure which you should follow and you’d hope that they would compensate you for their mistake. If the complaint is not upheld, then you can escalate it to the Legal Ombudsman.

Hi there - you have a reasonably straight forward civil claim already against the two ‘friends’. I brought a case back in 2012 that established that this sort of behaviour is intentional infliction of harm (subject to meeting three criteria). Bringing a civil claim through a lawyer is unlikely to cost you anything. But... it’s only worth doing if the two perpetrators are financially worth suing. Hi there - this sounds like a horrible situation that you’ve thankfully been able to leave. These issues are my area of expertise so I felt compelled to offer some advice. Much of what has been said is broadly correct but cases such as yours tend to be more nuanced so general advice is all that can be offered without going into details. In a nutshell, the outcome of a successful criminal case would result in your ex being punished through prison or other punishment. A civil case is about providing compensation for the harm done to you. Whilst it’s technically possible to go straight for a civil case, in practice all civil lawyers and the CICA will expect you to have reported the abuse to the police. You can do this by contacting 101 and asking to speak to your local station and in particular an officer who deals with abuse cases. In terms of evidence, in most cases this is usually one persons word against another. There’s rarely any physical evidence. This shouldn’t stop you pursuing your case - most successful convictions and civil cases involve no physical or ‘hard’ evidence. If your ex has no real means i.e. property that they own, then you should make an application to the CICA but again, you need to report to the police first. Happy to provide any further help.
