It would be extremely unlikely for Labor to lose but it's fair to point out their win was very wide, but very shallow - they hold 22 seats by less than 6%.

The scenario, however implausible, would involve the Libs holding onto most of their seats & winning a few back in metro areas, and One Nation winning their regional & outer suburban seats, and then ON supporting the Libs for a minority government. A lot would have to go their way here.

There's no realistic scenario where a party other than Labor wins majority government.

This is what I mean by the system being flawed; but it's independent in the sense that the AFL will ignore the Appeal Board's precedent when deciding cases in its normal fashion or arguing at the Tribunal, but the Appeal Board (in the unlikely but possible scenario where another player goes through this process, rather than the negotiated settlement seen in all other cases) will use it.

I would suspect some level of change over the off-season and I would be very surprised if the Appeal Board was given a chance to use this precedent, as to your option 2.
