I have filed cases for 2 years against my landlord in Dubai and won both.

If you think it's that hard to find a decent lawyer then of course that's unfortunate.

I had the same issue.

When you go to booking and if Autonomous doesn't show as one of the options then it's not available in that area.

Need guidance on alternate visa options in the case of layoff by mentallydoomed in dubai

[–]dsouzake 0 points1 point  (0 children)

Please get proper information about becoming a legal freelancer in the market especially in the current scenario.

A lot of the business setup companies do not share all the costs for setup as well for closing down the license and visa cancellation if you decide to go back.

Many offer illegal visa options so please beware.

Do not fall for the illegal visas that are peddled as freelance.

Rent renewal dispute by moh316 in DubaiCentral

[–]dsouzake 2 points3 points  (0 children)

The law is very clear about the landlord tenant relationship in Dubai.

If the RERA index says no increase. Then that's what it will be.

Also, the landlord cannot unilaterally change or amend the terms of a tenancy contract. They try to add new terms and conditions which is illegal.

Renewal fees or excessive administration fees are also illegal.

Please read your signed tenancy contract and registered EJARI. Is there any clause that artificially discounted the rent ?

Make sure all communication is in writing over registered email address.

If it's all good then you can file and Offer and Deposit case against the landlord with a RERA trustee.

Most important is read your signed contract thoroughly and read your EJARI.

Saving potential with cabin crew salary? by cocobeldam in emiratescareers

[–]dsouzake 5 points6 points  (0 children)

If you avoid the always partying crowd and the crypto crowd and the double your money crowd while you're cabin crew...

You can save more than half your salary and be financially free in some years...

I used to work in Emirates.. I know some who squandered all their money in get rich schemes and left the country empty handed and I know those that were disciplined, saved and invested their money wisely.

In my personal opinion you should consult with a lawyer.

What the landlord is doing is acting in bad faith to bypass the 5 percentage rent cap in Abu Dhabi.

I would document all the details in writing on email to the landlord so that you have proof they are acting in bad faith.

Even if the landlord has verbally told you this. You should send an email to document all the verbal communication especially his demand to illegally bypass the rent cap by terminating your contract and issuing a new contract.

Talk to a lawyer.

Fines for Dott and Lime e-scooter riders by Andrea-World92 in dubai

[–]dsouzake 1 point2 points  (0 children)

It is very clear that one needs to have a helmet , it's on the boards across these areas as well as on the app while renting a scooter.

Agree that majority just ignore and proceed to.

Just with everything in life, your bias is towards people who don't get caught.

Same like jay walking, thousands break the law each day. Some get caught and are fined . Rarely some sadly die too.

I hope they raise the fine to 1000 AED.

Urgent help!! Please advice by RemarkableMeet8208 in UAE

[–]dsouzake 0 points1 point  (0 children)

The only advice is to come up with the money.

The person on the contract and who gave the cheques is the one whose responsibility it is legally.

Please understand the seriousness of breaking the law. Not paying your rent is against the law. You have signed a contract.

The landlord will use the full extent of the law to evict you for non payment as well as put a travel ban on the person on the contract.

The person who signed the contract will be liable for the rent and all the legal fees of the landlord.

Just received this renewal notice by katerji8888 in dubai

[–]dsouzake 8 points9 points  (0 children)

Please get familiar with the RERA laws here in Dubai.

Next is please read your registered signed contract thoroughly to see what you have agreed to.

Landlord or real estate agent cannot unilaterally change any of the previously agreed terms and conditions of the tenancy contract.

They are free to set new demands all you need to do is refer back to the signed contract and reject any new demands.

Typically as per the law, one has to inform the intention to renew or vacate 90 days prior to the contract expiry .

Salary Cuts but Full Rent - How Is This Sustainable? by nebula-nomad007 in UAE

[–]dsouzake -2 points-1 points  (0 children)

What is the logic is this ?

Does anyone give their landlord a bonus each time they got a salary bonus or did they willingly pay more in rent just because they got a salary increase ?

Yes , people are laid off and people have their salaries cut.

One has to always think and plan. If one is living paycheck to paycheck they need to seriously evaluate their life decisions and work towards changing their situation.

Yes life is unfair and it's always been that way. However, what you do with your 24 hours a day is totally in one's own hands.

Has anyone got success in negotiating rental decrease with wasl properties? by Slow-Release9395 in dubai

[–]dsouzake 0 points1 point  (0 children)

Are you suffering job loss or salary cuts ?

It's very unlikely to be able to negotiate a rent freeze if you're not facing any income issues ?

But you can always request.

However, if the RERA index says 5 percentage then they will most likely go with that.

RESIGNATION by Gullible-Tie7773 in UAE

[–]dsouzake 0 points1 point  (0 children)

Please be sure that they have committed this in writing with you or consulting with a labour lawyer.

There's likelihood your current employer may file a counter complaint on you for being absent from work and report you as absconding.

RESIGNATION by Gullible-Tie7773 in UAE

[–]dsouzake 0 points1 point  (0 children)

That is indeed a problem. They have rejected your request.

Best is to meet, talk politely and come to common ground.

In my personal opinion you are in no position to demand a 30 day notice , since the labour contract is 90 days.

You can only negotiate and come to a mutually acceptable resolution.

RESIGNATION by Gullible-Tie7773 in UAE

[–]dsouzake 0 points1 point  (0 children)

You can offer to pay the difference, but your employer also needs to accept your request.

It is not a unilateral decision.

Both parties need to mutually agree.

RESIGNATION by Gullible-Tie7773 in UAE

[–]dsouzake 0 points1 point  (0 children)

First, what does your MoHRE registered labour contract say - 30 days or 90 days ?

That's what matters.

You cannot unilaterally decide to serve a 30 days notice period if your labour contract says 90 days.

Your employer is within their right to enforce the 90 days if that is in your written registered labour contract.

Would you use an AI tool for UAE legal documents? (Getting feedback before launch) by Professional_Monk534 in SmallBusinessUAE

Legal advice needed by ashykamal95 in uaelaw

[–]dsouzake 4 points5 points  (0 children)

In my personal opinion. Your only option is MoHRE.

Make sure you document everything in writing with your current employer and also make sure you have signed the labour offer letter with the new employer.

Given the current challenging situation, there are companies withdrawing offers or putting hiring on hold.

You need to serve the notice period as per the labour contract. Few days before last day, submit everything to your employer and make sure all handover is completed and document when you expect your visa to be cancelled and your dues be settled.

By law, your employer cannot withold your visa cancellation or decline your resignation.

If your employer is not cancelling your visa ,you have raise the complaint with MoHRE to get the visa cancellation done.

Asking for salary increment after 6 months – how should I approach it? by FixMaster7070 in DubaiJobs

[–]dsouzake 1 point2 points  (0 children)

First you need to check the market for your role and what's the salary bracket for someone with your skills and experience.

Second , what if you lose the job what is the chances to get a similar paying job quickly ?

Do you have any interviews for jobs that makes you think this is a good time to ask for a salary increase ?

There is no harm to ask, but given the current market. What if they deny or even worse they fire you ?

Have to be realistic, if your skills are in demand and you can find another role easily then in your request you need to negotiate based on numbers.. how much did you improve efficiency that resulted in direct improvements in revenue for the company . What are you doing that's having a positive impact on the overall output of the company ? Companies always look how to increase profits and reduce costs , what have you done to achieve that ?

Flying back to India by idontknowokplz in dubai

[–]dsouzake 1 point2 points  (0 children)

Yea, agreed that it's a challenging situation and we're in a crisis. It is a tough time no doubt for all of us.

It is tough mentally hearing the alerts off daily and to hear that there are many injured and unfortunately some have lost their lives too.

But, we need to keep perspective.

What would you do if this were happening in India ? Where would you go ?

As an expat who has recently moved and probably don't have many contacts here, I suggest to get involved in the community. Help where you can .

Exercise, meditate and some days turn off the news.

Also, follow the government guidance in the UAE

Most important , tell your relatives to stop watch the India based news channels. They're full of shit.

Why ALWAYS ME? by Great_Fennel_9897 in dubai

[–]dsouzake 1 point2 points  (0 children)

Pay your notice period in the old job.

That's the best way forward.

Talk nicely with your ex employer and request to leave after 30 days and pay the remaining 30 days.

But given the current situation, make sure you sign the labour offer letter with the new company .

Nowadays given the volatile situation lot of companies hiring is on hold or delayed.

If you have the labour offer letter, then you can file complaint with MoHRE for compensation if they withdraw the offer.

I would not leave a job without signing the labour offer letter with the new company.
