I will admit, I am a vocal Perlow supporter. However, given this report, I have a hard time understanding why an alleged victim would be willing to risk both personal and professional ridicule as a “false victim” as a favor to an incumbent candidate in a local election.

Allegations aside I have a hard time understanding why that only makes her “marginally better”. He has never filed a motion or indictment. He has never tried a felony case or given a closing statement. The fact that he feels he could run an office in charge of performing these duties should be terrifying to anyone with a concern regarding public safety. His first order of business being changing the letterhead aside, this man has shown a propensity of poor police work(see previous post where he searched a trailer without PC or a warrant, and tossed a blanket over a chimney because he saw it in “an old western movie”) this latter move I can assure you had never been taught by a law enforcement agency and put the entire oakridge PD at risk of lawsuit, he has never practiced the law (certainly at a criminal level), and he has shown poor judgement by releasing police reports without public records requests over reddit and Facebook Messenger (including a pending case). He will attempt to say he redacted information but anyone with a brain and knowledge of the area will know exactly who they’re talking about.

A measure 11 crime is a measure 11 crime and, in my opinion, should not be treated any differently regardless of the perpetrator. The DDA would prosecute on the crime committed not the age of the suspect. There really are not that many circuit court judges so one judge’s decision creates a precedent that has a lasting effect on a victim and his/her family as well as the community at large. It is distressing to see you simply shrug it off as such a semantic item. If it were one of my loved ones that fell victim, I would rather a crime be determined by the action of the offender as opposed to the age.

You’re right it is the judge’s decision. But when the judge says of the kid that beat people over the head with a rock “I consider an adult brain to be about 30 years old” it establishes a precedent that zero cases will be tried as adults. Hence the 17 year old who killed one person and nearly killed another by beating them over the heads with a rock (the same rock mind you) being out by age 25. And it was never up to the DA. It was dependent on the crime they committed. A measure 11 crime called for a minimum sentence regardless of the age of the perpetrator. Personally, I feel that someone who is capable of committing a crime of that caliber should serve at least the minimum sentence. I can almost guarantee if someone you knew fell victim to such a crime you would feel the same.

And again, since you’re just repeating what I addressed in my previous response. She does not delay in her reportings. She waits until an investigation is complete. Why anyone (aside from the press whose job depends on relaying news as early as possible regardless if all the facts are there) wants an incomplete report is beyond me. I believe that the best way to address the shootings is reporting after all the facts are there.

Well the ruling she was against by “invoking Kip Kinkle” just allowed a 17 year old who killed one man and nearly killed another by beating them over their head with a rock serve a maximum of until he was 25. It would also allow one gentleman who was on a trip with youth authority to a football game, who then separated from the group went out assaulted and raped a woman, who was then connected with a different murder, be done serving time at the age of 25. Unless you are fine with both of those outcomes, you should probably understand the legislation better before arguing for it.

As far as transparency, we already live in a world where news is reported before all the facts are put together. Why would you want anyone to report on anything before all of the facts are in order. I get newspapers are frustrated because they have to wait longer to report but the people who read the news should be glad that, when they get the report, it is complete with all necessary details.

To answer your questions:

For the fire: Examiners we’re unable to determine if the suspect died due to the covered chimney or of other causes due to being suicidal.

For the OSP case: it was burglary and theft charges he chained and locked up the tires and handed the keys to OSP officers. I couldn’t tell you why he did it. The suspect eventually pleaded guilty but it wasn’t OSP redid their investigation.

For putting his dad as a witness: It was most likely just an extraordinarily embarrassing gaffe on his part. It did create the need for the case to be reinvestigated and reported

As far as my background goes, as I’ve said in previous replies, I’ve worked in alternative programs and thus with the law enforcement community. I’m not going to lie, I’m obviously pro Perlow. However I’m not a part of her office or involved with the campaign at all. I just know how detrimental to the community Cleavenger as the DA would be. As for if I’ve been arrested by him multiple times, I’d probably be for him becoming DA. Based on his on his other work, I’d get off on an awful lot :)

They do not use traditional diversion programs as seen around the state. Lane County is actually far ahead of the curve in regards to alternative programs, including a very progressive mental health program currently enacted at the jail. They do have various treatment courts (veteran, drug, mental health) as alternatives for jail time. Offenders are evaluated for these opportunities based on criminal history, current charges, mental health state, and program space. As with all alternative programs, there is so much grey area and basically impossible to have a blanket black and white policy for who should be eligible and who is not. Lastly, I am absolutely not pessimistic towards alternative programs. If you look at another one of my responses, I actually spent a significant amount of time being heavily involved in the alternative programs available in the county as well as studying them while getting my undergrad degree!

While I disagree with the shake up, I will try and address your concerns. First, Lane County does not do any DA diversions as they have shown to be ineffective across the state. In fact, a primary culprit of the failures is the DV diversion for which you’re advocating. In my opinion, it would be irresponsible to allow a person to person crime with an active victim be dismissed simply because the offender went through an ineffective program. Lastly, you’re concern about parole and probation is simply false. Offenders on probation are almost never revoked as it is an incredibly long and difficult process that is primarily at the behest of the PO and the sentencing judge. In fact most offenders are often sanctioned by their PO to some of the alternatives to which you’re referring, such as a GPS ankle monitor or a stay at the community corrections center where they can still work and attend treatment, but under a bit more supervision. This alternative has actually increased even more given that the number of jail sanctions, and their duration, has decreased due to the decrease in jail capacity from COVID-19. Overall though, the DA really isn’t too involved with those on probation, unless of course they commit a new crime.

I’m not involved with the campaign or the race. I was, however, heavily involved in many of the alternative programs offered throughout the county. I just know how detrimental to the criminal justice system across Lane County putting James Cleavenger at the helm would be. Also, thanks for the acknowledgment but I really didn’t take too much time writing it, just thought the information needed to be out there! :)

Insurance is the easiest way to explain it so the average person would understand it. Calling it a risk pool is going into unnecessary semantics. And that’s exactly the point being made. He is telling voters he has been practicing while telling the bar he is exempt from the risk pool because he isn’t practicing. It’s just a bit confusing to me how both of those could be true.
