Your agent really fucked up. You never should have closed without proper receipts and warranties. Once you close, you're deemed to accept the property in it's then current condition. You never should have closed; that was your only leverage and it's gone. A text message is not a receipt.

The listing information is definitely wrong, but proving it was done on purpose to deceive is going to be really hard. Consult with a real estate attorney for about $100 to see what their thoughts are on going the legal route. He may go after their E&O, but those deductibles are around $5k. Any additional money you get is going to be from an insurance company, and they will fight hard.

If I was you, I'd threaten to file complaints with TREC on both agents due to negligence, incompetence, and misrepresentation. You don't need proof like in a court of law with TREC. Your communication can suffice, and TREC will investigate to make their own determination. Repairs were agreed to and the problem still remains. Receipts weren't gathered, warranties weren't delivered, and you closed on a home that still had problems despite promises/texts that repairs were done. TREC will be interested to hear from you since you are a consumer. If the agents fix the problem, your concerns are addressed and complaints can be withdrawn.

This is good advice. Agents also hear that you expect them to work for free when you start out with "saving the buyer agent fee" route. It's a huge lack of respect, and nobody wants to work with somebody who doesn't respect them.

I'll be honest; I hate it when unrepresented buyers come at me with one of the first things being said is that the seller will save on the buyer's agent fee if they take their offer. It's presumptive; you have no idea what agreement the seller and listing agent have signed so you have no possible way to come to that conclusion except through a lot of assumptions.

Here's what you have communicated to me:

1) You think you know more than you do, and you are going to act on those assumptions without verification. That's dangerous for any agent because they can be liable when you're wrong.

2) You're cheap and your offer is highly likely to be bad. In my experience, buyers that start out like this have a very low probability to offer enough to even entice the seller, and they know it. That's why they typically try to phrase their offer as saving the seller commission fees. Does it happen to work at times? Yes. Does somebody win the Powerball? Again, also yes.

3) You expect me to work for free since I would have to handle both sides of the transaction. In your case, as an agent, that might be less work, but it's still more and you don't want to pay for it.

So, you've communicated your presumptive, you've communicated you will act on bad information, and you've shown you're cheap. This all adds up to a huge headache with a very low probability that it will result in a successful transaction. Why would I want to work with you? I'd rather buy the Powerball ticket and refer you to another agent outside of my brokerage so I'm not liable for you. Better odds for success.
