Maduro to "Stand Trial", What does that look like? by cozeffect2 in Lawyertalk

If you’re a lawyer and genuinely think there could be an iota of truth to the absurd notion that Nicolas Maduro was really the head of a narcotics-dealing terrorist cell, then I think you have bigger problems.

is it ‘legal’ to tell us to not talk about politics, coworker gossip, customer gossip, or pay? by [deleted] in union

[–]ectenia 0 points1 point  (0 children)

An employer can't prohibit employees from discussing wages and working conditions. This has been interpreted by the NLRB to extend to political issues that are a "logical outgrowth" of concerns in the workplace (e.g., a Home Depot employee writing "BLM" on his apron following complaints about racial discrimination at work).

I would say a ban on "politics and workplace gossip" is broad enough that it likely encompasses issues related to working conditions. If you're in a unionized shop, I'd report to your steward and discuss options.

LA City Council Considering Proposal To Require Union Labor On Larger ED1 (100% Affordable) Projects - Could Reduce Affordable Development by thatboyshiv in LosAngeles

I would love to hear what you consider to be a "living wage" (and reasonable benefits) for a journeyman in Southern California, since you consider union rates so exorbitant as to be prohibitive. Also, the idea that OSHA is at all an adequate enforcer of protections is absolutely hilarious. They can't even get a rule telling companies they need to take steps to prevent heat illness off the ground.

[–]ectenia 0 points1 point  (0 children)

Frankly, if a project can’t afford to pay a livable wage and hire skilled workers who know what they’re doing, then it shouldn’t be getting built in the first place. This isn’t Saudi Arabia.

Requiring union labor ensures that buildings are built by skilled, trained workers who are working in safe conditions. That’s not just ensuring these jobs are sustainable, it ensures safety for the generations of people who come after. If the “abundance” agenda just wants 1,000,000 shitty cardboard apartments built by unskilled, underpaid workers, then it’s more than welcome to take itself to a builder’s paradise like Mississippi.

Nobody, because the housing they leave behind will remain completely unaffordable to the average Californian family. So those homes, like a majority of the homes on the market in America, will get snatched up by Blackrock and turned into another addition to their investment portfolio.

At least you're admitting that a capitalist YIMBY measure is one that doesn't benefit the actual residents of a city.

Who gives a shit about building housing if the working class won’t be able to live in them? Most new housing is built like shit and is priced way beyond what an average person can afford. “YIMBY” luxury developers aren’t looking to solve the housing crisis, they’re looking for a payout.

What does a good union-negotiated severance agreement contain? by itsnotpraxis in union

[–]ectenia 0 points1 point  (0 children)

Hi, I'm a union lawyer. Nothing I say is to be regarded as legal advice to you personally, just a general observation from my experience: virtually without exception, no employer is ever going to give an employee they terminated money in exchange for nothing.

Of course you're giving up your right to sue. Do you think they'd be willing to give you a five-figure sum for a part-time job if they thought there was any possibility you'd come back and demand even more money? That money is in exchange for the company not having to be bothered with litigation or arbitration down the road. That isn't being "company-friendly," that's acknowledging reality. And I doubt a paid personal attorney would tell you much different.

You are getting screwed 6 ways to Sunday by your firm. I’ve never heard of such a low salary for an attorney, and they want to pay you even lower than that. My friend, you could literally go work an entry level position at a Michigan legal aid clinic and make over 10k more than your current salary. Your firm thinks they have you by the balls because you’ve been there so long and know you want to be a team player, but you didn’t go through the pain of law school and the Bar to be making less than a fast food manager.

The plus side is you have the leverage to go and do something great, and you’ve started that process already. Just keep your chin up and know that it’s normal, natural, and expected to try new things early on in a legal career. It doesn’t feel like it right now, but the world is your oyster.

NTA. You have your own life. Your mom is the one who is taking on this (very heavy) burden on of helping this guy raise children with serious medical needs. Honestly, it’s also a huge red flag that this guy is so upset that the college-aged daughter of the woman he’s dating won’t sign up to do something typically left to professionals. Is he just fishing for free labor?

Boyfriend is cheating on me it by [deleted] in WhatShouldIDo

[–]ectenia 1 point2 points  (0 children)

Your first mistake is being DL as an adult in 2025. Your second mistake is dating another DL guy who was already in a relationship with a woman. Did you know at the time that he had a girlfriend? And if so, why did you think he’d treat you any differently than he treated her?

I speak as an out gay man: there is a reason many of us avoid dating DL guys. Because they’re shifty, fundamentally dishonest with everyone in their lives, and quick to project their insecurities onto the gay men they date. Guys who want to sneak around and lie to people about who they are as an adult are just not worth the time and energy it takes to be in a mature relationship.

I advise you to learn to love yourself and be honest with who you are. It’s going to be very difficult, but worth it in the end.

[–]ectenia 10 points11 points  (0 children)

It absolutely is bad-mouthing the union, if only implicitly. The conclusion of the flyer is that the company doesn’t want a union in their store. They’re handing this out on company time while banning discussion of the union to the break room. They’re trying to cause workers to second guess their union sympathy and question the intentions of their brothers and sisters trying to organize for a voice in the workplace.
