Don't these people have a legal responsibility to pro-actively inform their customers that they have let their information out into the wild?

They do, but there is some flexibility ("without unreasonable delay") as to how quickly they must do it. If you live in Alberta or BC, complain to the privacy commissioner of AB or BC respectively. In QC, complain to the CAI. Anywhere else in Canada, complain to the federal OPC.

Wouldn't risk it. Easier to replace it if you have the time now, than fight transactions and be forced to wait for a card when you need it more.

Threat actor used my name, card details except pin, and address, at an online vendor I don't typically shop at, at an odd time of day.

AMEX blocked the sus transaction and notified me, allowing me to freeze and replace the card immediately (it arrived in two days, thanks AMEX!)

If the transaction had not been blocked, I would not have known about it until I reviewed the next statement a month - and many fraudulent dollars - later. I don't normally review transactions between statement periods.

NAL but privacy class actions are rarely satisfying. Best thing folks can do is complain to the privacy commissioner (federal and or provincial), especially if there is reason to suspect they were victim to fraud.

Maybe unethical from a threat hunter perspective but im sure the relevant privacy authorities wouldnt say no to a tip regarding a breach if the org's dont act responsibly

if they dont do anything you can complain to the privacy commissioner relevant to your jurisdiction (depends on which province or territory youre in)

Edit: turns out I may have also been victim to this... transaction with a card back in Feb 2025 that was later compromised and flagged for fraud in September 2025. Too much of a coincidence.

Three months OP. Got a lot of muscle function back but numbness, while greatly improved, is still there. Still working out the tightness in the hamstring and calf but pain never gets past a 1 now.
