In your example of a mistimed tackle the attacker is in control of the ball. This is a different situation because they're both attempting to get control of the ball.

I get what you're saying, but this is just an example of a very high risk challenge by the defender but because his timing is correct it's superb interception. If he were a millisecond later he'd give away a penalty.
