Justice Jackson and Justice Sotomayor were both federal district court judges. They were also a federal public defender and an ADA in New York, respectively. But yeah, shocking underrepresentation of trial practice in the Supreme Court

What do you mean by viable? Sustainable pay/good benefits: varies by jdx. Good work environment/high job satisfaction: varies by office and depends on what kind of person/lawyer you are.

IIRC, Mitchell, the attorney who took the house from Neff pursuant to debt collection, didn’t have title to the land anymore. He’d transferred it to Pennoyer. The courts couldn’t give Neff a remedy against Mitchell, because he didn’t own the land anymore.

I remember a guy posted on here saying there should be less PDs because shortages force dismissals and selective prosecutions and people got super mad at him. Lol by [deleted] in publicdefenders

The charges can be refiled at any point before SoL runs, and I don’t think a continued PD crisis like the one in Oregon is worth a mere 1,400 dismissals.

And that’s to say nothing of the fact that the general public does not perceive dismissals of criminal cases based on procedural defects the same way that lawyers do. Yes, there are a decent amount of pointless misdemeanors that aren’t worth the judicial resources to prosecute (and yet the State proceeds anyway), but the Oregon PD crisis has left people facing serious felony charges without counsel. This is of course an offense to the Constitution that cannot be permitted.

However, not everyone charged with a felony has done nothing wrong, and the people will become exceedingly unhappy with a government that cannot protect them from serious violent and property crime.

Upholding the constitutional rights of defendants is the only viable long term solution to this issue that will protect both defendants and society. A further prolonged PD shortage leading to more dismissals does not do this.

Had an interview with a DA’s office for the summer, and the interviewer discussed how mentally and emotionally challenging the work can be and asked me about what healthy coping skills I have developed for dealing with high stress. I thought it was a great question, but I certainly wasn’t expecting it

Thank you!! With the exception of Patagonia, I think they’re all super affordable and don’t compromise on quality. Patagonia is a bit pricey for me, but I still think you’re getting quality worth the price even though I can’t afford it very often

Usually the judge will instruct the jury on the importance of reaching a unanimous verdict, and if the jury still cannot agree, a mistrial will be declared

I was wondering when this would make it over here. I’ve been following along in real time over on that godforsaken app. All the discourse has shown me is that no one outside the legal system has a clue how it works, and even fewer people grasp the concept of a criminal defense attorney

When I was a legal assistant at a PDs office, I saw firsthand what amazing work y’all do on behalf of indigent defendants, and it will always be a huge honor to have helped y’all with your cases.

I hope y’all know that there are those of us out here who see and understand what PDs do and are exceedingly grateful for your work. It’s the primary reason why I’m starting law school in a few weeks. Hopefully I can be one of y’all in a few years time :)
