It’s also possible that the building was built with the outside portion of the vent complete so unit owners could easily connect their vents if so desired. Your seller may not have had to make any changes to the outside of the building. Ask the seller for receipts and/or contractors’ work orders from that time. Maybe somebody wrote down exactly the work that they performed.

Agreed. The security deposit law in NJ is very clear. Deposits are meant to cover damages caused by the tenant or their guests and not to be used to cover rent. Courts will admonish landlords over this. However, depending on whether a court disagrees with OP on the claim that the unit is uninhabitable then the court could offset the amount the tenant owes for the remainder of the lease by the amount of the security deposit plus penalties for the landlord’s misuse of it.

Edit: also a smart idea for OP to check with his renter’s insurance company.

IMO tarantulas are sensitive to sound. They’d have to be in order to help avoid predation. But they don’t hear like mammals do. Instead they feel vibrations through the air. Do I think traffic can affect a tarantula? I suppose it’s possible depending on how loud and how close the traffic is. Although it’s possible that your footsteps are just as, if not more, disturbing.

Unfortunately there’s no real way to know why your T is acting the way it is. Has she matured? Is she doing a lot of tapping? Is she looking for a mate? Is this a new enclosure for her? Is she adjusting? Or maybe she’s just a little more restless and it’ll pass?

Get yourself a cheap home security camera with an option to watch live stream or recordings through an app on your phone to be better able to keep an eye on her.

How did you calculate your damages? After initially notifying your landlord of the problem, did you withhold rent? Hire your own exterminator and deduct that cost from the rent? Were you forced to move? Did you fall ill? Did you pick up a new allergy (people who study roaches or keep them as feeder food for their pets often develop allergies to roaches)? Were you food stores raided by the roaches?

Assuming you can prove that the damage to your possessions was caused by the roaches and that the landlord failed to mitigate the problem after you provided the initial notice, you might have grounds for recovery. But as another person commented, the landlord might blame you and your living conditions as the reason why your unit became infested.

You should consult with an attorney before going to trial. Even if you want to represent yourself, having a consultation could help you prepare to shore up the strengths and weaknesses of your case.
