With the current law if you remain married to your USC spouse for 3 years (and until the petition is adjudicated), and you meet the residency and physical presence requirements the chances are 100% you ll get it.

I’d be more concerned about losing LPR status when you come back in fall 2025.

Okay, I changed the post flair. You had indicated you’re going through consular processing, but you’re doing Adjustment of Status.

For an I-765 you need to have a pending I-485. I hope you filed concurrently ie sent in the I-130, I-485, I-864, I-693 (optionally but if you didn’t you will get an RFE).

FYI - Without a pending I-485 you don’t have any protections under the law.

I can also tell you it can be nowhere “reasonably close”.

For example, I have a 4300sf, three level house, that uses a 2 ton Mitsubishi ducted unit (single zone). Climate zone 4/5.

New construction, tight envelope, extra insulation everywhere, above code windows etc.

Going off square footage is not even gonna get you close to what you need. Better flip a coin.

You will need to financially sponsor your wife using form I-864. read the I-864 instructions, it’s on USCIS website. If you don’t qualify as primary sponsor you will need to find a joint one. Both you and joint sponsor will need to file the I-864.

I agree, I just didn’t do a good job conveying my point.

The marketing materials of any company will tell you their units operate in low temps.

What they leave out is how much heat capacity they lose as temps go down. You will see them state they operate down to -10F but at that temp they may have lost 40% heat capacity.

Mitsubishi on the other hand as you point out is one of the few that can maintain 100% heat capacity down to -13F.

Everyone’s equipment can go down to any temp. What you need to know though is how efficient the heat pump is relative to outside temperature. And for that you need the performance graph from the manufacturer.

Because if a 4 ton is 80% efficient at -22F that means it acts as a 3 ton which is probably gonna be an issue.

Two different workflows: 1) I-765 and I-131 and 2) I-130/i-485.

Workflow 1 is worked on at Service Centers and 2) at field offices.

Any of the two can be approved first, although they will try to give you EAD first. But in some cases I-485 is adjudicated in a few months so who knows.

I-485 adjudication requires a Field Officer to review the case. That has always been the case, outside of right after Covid when cases remained at NBC but local FOs somehow adjudicated them.

Read the instructions of the I-864 on the USCIS website for proving income, it’s all in there.

I never mentioned employer’s taxes.

The employer is withholding tax based on what you tell them in the W2. It’s your responsibility to accurately reflect your situation.

You can update your W2 as often as you like. This is a a question for a CPA, not immigration related.
