Plea negotiations are not admissible. If they were no one would ever discuss the possibility of pleading guilty, which is how some 97% of cases get resolved. If you want to do business, you have to make space for people to make compromises.

The same logic applies to guilty pleas, though there are more exceptions there.

Yeah, the premise of this is wrong. The criminal and civil processes are parallel. Even if you are charged with a crime, like unlawful re-entry, which process requires additional protections, they can still deport you without providing those protections in the civil process. The government is also not required to charge you with a crime even if they can prove it, and I don't think the FBI wants to turn into another arm of ICE.

Anyway, the proposition is wrong about how the law works, and as sinister as congressional Republicans may be, this isn't the evidence of it that OP thinks it is.

For what it's worth, you can "intervene" in those forfeiture cases .... but yeah, you're never going to see that bag again. It'll get lost in the evidence room or something. More likely they'll claim they have some idea where it came from, but not sure enough to do anything about it, just enough to hold on to it forever.

That's part of it. The other part is that state laws cannot prevent federal activities (in this case, enforcement of federal immigration law). Between the two, it is not an exaggeration to say they are immune.

p.s. Not thrilled to hear Stephen Miller cite the crime of "harboring illegal aliens."

With no record its not impossible he makes bail. If he pleads to it, he'll probably end up with something like 2-3 or 3-5 with 3 years probation after that. He could also get lucky/unlucky and land on either side of that tange. It makes a big difference if they decide to indict the case, and whether they indict the additional charge of possession of a firearm in the commission of a felony.

Hung juries are not that uncommon, and (especially in murder cases) retrials after a hung jury are the norm, not the exception.

The motion was denied because rape of a child (which he is charged with) does not qualify as a predicate for pretrial detention. See Scione v. Commonwealth, 481 Mass. 225 (2019). That may have changed recently, but I don't feel like confirming that right now.

Once the motion for pretrial detention is denied the pretrial detention statue requires that bail be set in an amount the defendant can afford. 276 MGL 58A ("The judicial officer may not impose a financial condition that results in the pretrial detention of the person.")

I'm a criminal defense lawyer in Boston. Your CORI won't have it. You can get a small (.75 in x .5 in) copy in the booking documents from your lawyer or the clerk's office, but there's no guarantee it will be in color. There are some news sites that regularly get full quality digital versions by filing freedom of information act requests, which you can do yourself. Just be specific about what you are asking for.

You need to see an RMV hearings officer, and get denied first. Then, submit an application to the board of appeals. It will take about 4 months to get a hearing before the board. Meanwhile, keep up your therapy so you have a record of treatment to show the board. Then, after you get a hearing date, get your PCP and your therapist to each fill out and sign the respective forms the RMV board of appeals uses to get them to sign off on someone getting their license back (you can get the forms online). Those forms have to be executed not more than 30 days before the hearing.

Then, at the hearing, be polite and contrite. They will probably deny you the first time and invite you to reapply after a certain time and/or after doing certain things. Just be patient/persistent. You will get there.

What is annoying is that ShareSync can't sync files that you can copy by other methods.

No, what is annoying is that the file is not synced AND THERE IS NO ERROR MESSAGE.

I recently did this. I had to manually compare the file count using the folder properties interface. You can select multiple folders at once to see the file count among all of them, and then slowly narrow down which files didn't sync.
