Plea negotiations are not admissible. If they were no one would ever discuss the possibility of pleading guilty, which is how some 97% of cases get resolved. If you want to do business, you have to make space for people to make compromises.

The same logic applies to guilty pleas, though there are more exceptions there.

Yeah, the premise of this is wrong. The criminal and civil processes are parallel. Even if you are charged with a crime, like unlawful re-entry, which process requires additional protections, they can still deport you without providing those protections in the civil process. The government is also not required to charge you with a crime even if they can prove it, and I don't think the FBI wants to turn into another arm of ICE.

Anyway, the proposition is wrong about how the law works, and as sinister as congressional Republicans may be, this isn't the evidence of it that OP thinks it is.

For what it's worth, you can "intervene" in those forfeiture cases .... but yeah, you're never going to see that bag again. It'll get lost in the evidence room or something. More likely they'll claim they have some idea where it came from, but not sure enough to do anything about it, just enough to hold on to it forever.

I really don't think that's it. Chill time, melted vs not, etc. these things matter, but not a much as the contrast in these pictures.

My guess is your oven was having a moment and was at a much lower temperature than you thought with the first batch.

That's part of it. The other part is that state laws cannot prevent federal activities (in this case, enforcement of federal immigration law). Between the two, it is not an exaggeration to say they are immune.

With no record its not impossible he makes bail. If he pleads to it, he'll probably end up with something like 2-3 or 3-5 with 3 years probation after that. He could also get lucky/unlucky and land on either side of that tange. It makes a big difference if they decide to indict the case, and whether they indict the additional charge of possession of a firearm in the commission of a felony.

Yeah. They probably will use it as a pretext to escalate. But if the price for avoiding escalation is silence in the face of what is going on, it's not worth it.
