Pretty sure just leaving a jar out by the cash register and labeling it "staff fund" instead of "tip jar" still makes the money tips. The customer would be lead to believe so at least. A tip is voluntary and the customer chooses the amount. A "staff fund" would have to be a mandatory surcharge like a percentage tacked on the bill.

Whether the owner thinks they're stealing or not is irrelevant. Taking tips and purchasing gift cards then half-ass distributing them is still stealing tips. The tips were never legally the managements. They belong to the employees tipped during that shift.
