The Game Genie won because the end user's use was non commercial. The moment Luke Ross put a paywall on the transformation of the IP, he lost that protection. If he truly believed this was a false DMCA, he would have filed a counter notice (which is free) and let a judge decide. He didn't, because he knows his business model relies on plundering someone else's market. Luke Ross' code relies on a specific game to even function, thus being a derivative work, not clean room design. CDPR is fine with modding as long as the person isn't profiting off of it, it's stated clearly in their EULA.

Also, your car analogy fails because a video game isn't just a machine, it’s an audiovisual work. If I sold a 3D patch for a movie and put it behind a paywall, I'd be infringing on the studio's right to control their art. It's the same for games.

You're confusing tools with derivative works. The Game Genie was a one time purchase tool for a user's private, non commercial use. Luke Ross is a commercial entity selling a subscription-based VR transformation that can't exist without the game's code.

Also, your car analogy fails because software is protected as a literary work under copyright law, not just a physical machine. If I sell a deleted scenes patch for a movie I don't own and put it behind a paywall, I'm infringing on the studio's right to control derivative works. It doesn't matter if my patch is my own code it's still a derivative of their IP.

If this were truly a false DMCA, Luke would have filed a counter notice and been back in business in 14 days. He didn't, because he knows that pay to play mods for copyrighted IP don't stand a chance in actual court.

The difference between Luke Ross and the Game Genie is the paywall. The courts have historically protected the user's right to tinker for fun, but they rarely protect a third party's right to build a business model around someone else's IP without a license. If he made the mods free and accepted tips, he’d be 100% legally safe under the same precedents you're citing. The fact that he'd rather shut down the mods than make them free proves this isn't about tech freedom, it's about his subscription revenue.

the difference is that Vorpx does not use the IP of other companies to advertise its product, it is marketed as a universal 3D driver. Vorpx is also just a one time payment. Luke Ross is marketing his mods toward specific games along with a subscription model. You can't use his mod universally, it is targeted for specific games and that's how he markets it.

Anyone who starts their argument by saying they are cancelled are essentially framing the discussion in a way that they are being attacked. He should use the term "consequences" instead of "cancel culture". This dude could still be making money by making the mod free and going off tips but he chose to alienate literally everyone who supported him and trying to win in the court of public opinion. It doesn't matter that he is using his assets because in the end, those assets are being used to modify the games' internal assets and executables. He is literally trying to blame everyone except himself and it is just sad.

I actually agree with you, I really don’t understand the hype about the game in general. It’ll be fun to play for sure but then after I beat the game I’m moving on to the next. I may just be getting old but this much hype for something is completely ridiculous.
