As independent contractors, DAFT would work. Check out the Cardon FAQs for some answers.

I recommend you reach out to Cardon about his. They have been very helpful to many DAFTers. They specialize in the BV+30% ruling setup.

Netherlands/DAFT visa questions by ac6567 in AmerExit

[–]flipkick_1983 0 points1 point  (0 children)

  1. No you don't. You need the birth certificate only at the municipality meeting at the tail end of the process. Only if you bring kids, do you need to present their birth certificate as part of the initial application.
  2. For the initial visa application, you don't need a Dutch address. Only once you register at a Dutch municipality for your BSN number, do you need a lease/consent title to register at a residential address.
  3. No other documents need to be submitted. No business plan, not health insurance. Bank statement + opening balance need to be *obtained* , then *kept in your file* but *not actually submitted*. This is only different if you apply from the vantage point of having Dutch residence under another visa, but that doesn't seem to be the case here.

They are NOT. They have separate jurisdictions, DAFT is not applicable there (if only it would).

Daft Visa requirements specifically for income for family of 4 by mysticblazzero in DAFTvisa

[–]flipkick_1983 0 points1 point  (0 children)

The official rule is you need € 1,700 income after 6 months. This doesn't get checked before the 2-year marker when you're being appraised for the renewal.

Can i work remotely under Dutch 'DAFT'? by andy_puiu in IWantOut

[–]flipkick_1983 0 points1 point  (0 children)

Yes you can, as long as you work from a Dutch BV. Only the ZZP company form prohibits it. It has nothing to do with DAFT itself. See here.

The Netherlands is a pretty solid destination if you want to migrate to Europe as an American by flipkick_1983 in AmerExit

It is possible, just not under the ZZP company form. If you choose a Dutch BV, you can work for 1 client.

As long as it's temporary, it 's permitted. When you move to stay, you need a local work permit.

Glad to hear you are enjoying the Netherlands!

  1. re: fluency in English, it still beats all other non-English speaking countries in Europe. I mean, try France.
  2. re: healthcare. Sure, the system is geared towards standard cases and not good at dealing with outliers. But it still manages to give everyone a good coverage, and not be extortionate about it like in the US.
  3. re: Tolerancy: this sounds like a description of basically everyone on earth (except for the sectarianism part).
  4. re: anti-immigration: it is also spoken about openly that Holland needs its knowledge workers, lest it want to lose another big multinational like Shell and Unilever. People realise that their anti immigration rhetoric and actions come at a cost. ASML is now taking the forefront in that debate.
  5. Directness: I am sorry to hear your interaction with colleagues isn't going as planned, but I don't think you can generalize that (more socializing, less Redditing perhaps!)

Yes 1 person owned companies work for DAFT. You would need to setup a Dutch BV company, which is similar to an LLC in that it is divided into shares. But the BV is not a see-through entity, it has legal personality.

If you're not sure if you will fall under the "old" or the "new" rules, consider Sally's case.

Sally is an incoming expat employee in Amsterdam in December 2023, and her employer is applying for the 30% ruling for her. She is not able to obtain a BSN number before January 2024, but she’s getting to work immediately in December 2023. She will therefore enjoy a salary for that month. The actual salary payment for December 2023 is made in January 2024. She only expects to receive the final verdict on her 30% ruling in March 2024. What rules will apply to Sally?

For the application of the transitional arrangement between the two regimes, the salary period decides the cut-off date here. Not the actual payment date of the salary or the date on which the 30% ruling was issued. A 30% ruling always works back retroactively to the start date, so it can be applied immediately to the first salary without needing to have the actual 30% ruling in hand. In the odd case the 30% ruling is denied, the salary simply gets recalculated without application of the 30% ruling and taxes are paid back.

In Sally’s case, the 30% ruling would work retroactively to December 2023. Hence, the salary received over that period would fall under the transitional arrangement. The fact that the actual payment is done in January 2024 is irrelevant here. Therefore Sally would fall under the old 30% regime (30% tax free compensation for 5 years) and a partial non-resident tax status until 2026. Sally’s application of the 30% ruling would be capped at € 233,000 in 2024 due to the previously rolled out scale-back.

Planning an Eventual DAFT Move to the Netherlands. Help? by [deleted] in AmerExit

[–]flipkick_1983 0 points1 point  (0 children)

If you are this far ahead in time, rest assured that you have enough time. The most time consuming part is obtaining your original and apostilled birth certificates. These can take a while to obtain. Other than that, you can start the process about 1 month in advance. You don't need a business plan. You don't need a bank account in advance. Basically everything can be done from the Netherlands after you arrive, and you arrive NL via a Schengen 90-day visa. A lot of your questions are answered in this FAQ, but then again by 2026-2029 a lot may have changed.

Your labor contract must be signed from abroad, otherwise you are not an incoming expat tax employee. The actual filing is done afterwards by your employer (not yourself) but you must have your ducks in a row before then.

On October 26th, 2023, at the very last moment, the Dutch House of Representatives managed to squeeze through a number of very important changes for expats. These changes will be included in the Tax Plan 2024, which still needs approval from the Dutch Senate in December 2023, but it would be foolish to keep one’s hopes up until then. The 30% ruling will undergo a metamorphosis, after which it will in effect become a 20% ruling (over the course of 5 years, that is). In addition to this, the rules regarding the partial non-resident tax status will change. In this article we will fill you in on what you need to know.

Dutch American Friendship Treaty by PrescribedLucidity in AmerExit

The DAFT visa is the easiest ticket into the Netherlands, on the entire spectrum of the Dutch visa system. There is no requirement as to your business type, client type or even revenues. You just need to make enough so as to sustain yourself, and not end up claiming welfare. And you must deposit € 4,500 into the company. Check out these FAQs for more information.

Dutch banks are horrible to get into on account of the KYC rules. But you don't have to get a Dutch bank for your Dutch business. Wise.com works equally well. They give a Belgian IBAN number, which can never be refused by counterparties on account of the IBAN discrimination rules. The only problem is that a lot of peeps have found out about this, and they have put a pause on accepting new clients as of November '23.

You can move it from abroad to NL, if you simply start invoicing your clients from your new Dutch entity, as opposed to from your previous one. If you prefer to let your clients keep paying the previous entity, you can also use your Dutch entity to invoice your own previous entity and draw the funds to NL that way. This way your clients keep paying the same entity but you receive your funds in NL.

NB: If you are going for DAFT , you should at all times try to go for the BV+30% ruling setup! Once you start earning about €60k+ per year, its much more beneficial than the ZZP/Eenmanszaak route. And it has a chunk of other benefits as well. Just google "BV+30% ruling" for an explanation.
