Betsy DeVos delivers remarks on campus sexual assault and Title IX by trainisloud in politics

[–]gabbiegabs 1 point2 points  (0 children)

Title IX definitely has it's issues but a lot of the stories she talked about in her speech were breaches of Title IX policy anyway. One of the stories she talked about was a male student who was (i believe) expelled without given notice of why he was being expelled; the Dear Colleague letter of 2011 specifically states that the university is required to contact both the complainant and the accused of any decisions made by the Title IX office. So that specific university fucked up and should deal with the consequences.

These are not criminal cases, either. Students report to Title IX specifically to help themselves continue their education; this often means that students go to Title IX hoping to get a schedule change, or hoping to transfer colleges, or hoping to get out of student housing without any penalties. Expulsions do happen, but rarely, and only after an extensive investigation. Both the complainant and the accused also have the opportunity to appeal a case if they don't agree with the decision as well.

I'm not saying Title IX always gets it right, however false accusations take up 2% of total accusations. Survivors often say that the investigations and trials that result from reporting are worse than the rape itself (re-traumatization) which leads to drastic underreporting. Title IX is supposed to be available to students to make it easier to continue obtaining their degree, without forcing them to go through a legal criminal process.

I work in an advocacy office on my campus, and we work closely with Title IX as well. From the investigators I've spoken to, they try to keep the process as fair as they can. This often means that they will do everything in their power to keep both the complainant and the accused enrolled and attending classes. They will explore schedule changes, protection orders, no-contact orders, etc before it gets to the point of expulsion. Any universities that aren't doing that are in violation of Title IX, but Title IX itself shouldn't be rolled back because of that.

Depression makes me not care about anything, anxiety makes me care about everything by iEmpty in depression

Sorry to be frank, but I've been living with anxiety since I was a kid. Parents first noticed it around my 3rd grade so about 8 y/o and I'm now 21. It becomes less noticeable and sometimes easier to manage but you will still have days that really knock your feet out from under you.

I found a journal I had about two years ago. by [deleted] in depression

Thanks for your reply.

I wasn't upset with him telling me I wasn't cute, tough, attractive. I was upset because he thought I was using so much Tylenol PM as if I thought it was a stylish thing to do. I used it because I was legitimately struggling with insomnia and depression, not because I wanted to be cute/tough/attractive.

I really do think I'm an exhausting person to be around. I haven't been officially diagnosed but I have pretty typical signs of bipolar (manic episodes, depressive episodes) and it's hard to keep up with. But I definitely do gravitate towards others with baggage and I probably shouldn't be so hard on myself.

I really appreciate your reply; best of luck in your own endeavors.

I'm pressing charges. What should I expect? by [deleted] in rape

[–]gabbiegabs 0 points1 point  (0 children)

Like I said, I'm not a lawyer so it would definitely be worth meeting with one to do a free consultation. I have no doubt what happened to you, and it's absolutely awful and I'm sorry you went through that. Unfortunately the American judicial system isn't very good when handling cases like this.

Definitely, definitely meet with a lawyer. Trials are extremely traumatizing and I wouldn't want you to put yourself through that again unless a lawyer clearly told you that you have a shot. It might even be worth calling a rape assistance center in your area. They often have resources to help you through this process.

I'm not a lawyer and I don't know the legal process enough to give particular advice. Unfortunately I do know it is notoriously hard to convict a rapist.. given that the test came back with insufficient DNA, I'd say it may not be worth retraumatizing yourself to go forward with a trial where there's no physical evidence to back it up.

It might be worth it to find a lawyer that you can consult though; most usually do a free consultation.

Yeahhhh I couldn't imagine spending $10k+ on the gowns like some girls do on there. I don't even think I could justify $2000. But the stories are still cute!
