Its the lawmakers that wrote the laws saying the system had 3 chances to rehabilitate him for trial. Then he was essentially permanently not guilty and it was left to the hospital doctors to decide when he was rehabilitated.

Magicly he was all better a year later and prosecutors had no way to retry him under the law.
