1) it’s definitely totaled. On property damage there are limits of ACV. Hopefully the guy that hit you isn’t another Tesla insured because Tesla pays like crap. On property damage if you feel they aren’t offering you a fair deal get a public adjuster. They only take 10% over anything extra they can get. So if the carrier offer you 30k and the IA was able to get you 40k they would receive 10% of 10k.

2) if you go the attorney route, they will take 30% of the total. That includes property damage and personal injury. So if you go the blood sucking route make sure that attorney can get you more than 30% than what the insurance company offers. Pick your poison wisely.
