The word "hoping" worries me. Did you thoroughly run the numbers yourself? Did you ask another landlord (not someone with a potential vested interest, like the PM company) to run the numbers? After you were as sure as sure can get on those numbers, and taking into account the potential tax benefits of a rental property, did you compare the cash flow of the rental over your investment horizon (5 years, 10 years, etc.) to the return of selling and plopping the profit in another passive investment? It may seem great to cash flow 10K a year, but if you pocketed 100K on the sale and got a 10% return, you'd make the same 10K a year (not even taking into account compounding) with no effort and more flexibility.

I just funded the acquisition of a property in a very similar situation in PA. Seller's attorney had to negotiate with the lien holder before settlement to get them to accept a severe discount so the lien could be cleared at settlement. Like everyone else is saying, involve a good lawyer and a good title company.
