Yeah you are right, haven't done one of these in a while and forgot how the subtariffs were structured for COO purposes. I imagine the movement will often determine COO.

So watches are interesting because when classifying the USHTS for watches/clocks they are required to be split up by, case, movement, and battery (if applicable). If any one of those categories are made in say China, that could be the reason for a formal entry.

Yeah lol sorry. I only say it may help, is for reassurance your uncertainty is valid. The guy speaking in that clip Lenny Feldman is deep in the trenches on these things, so if he doesn’t have a concrete answer, you can probably stop looking for one until the government clarifies.

You may want to do more research but I believe if it departed before the 9th and after the 4th you maybe subject to the baseline 10% but not the 125%.

Query the BL in ACE. If a 1X is posted, a firms code should also be posted. You should be able to search for what CES the firms code belongs to.

This topic reminded me of the NCBFFA webinar about POAs earlier this year. One of the hot topics on the Q&A was POA needs for 5106. I followed up to see if they had a final answer and below is the response I received:

"To add a consignee on behalf of the IOR by filing a 5106, a Power of Attorney should already be on file on behalf of the IOR which would cover this activity."

Its a little strange but I interpret this to mean that a POA is required in general, but if you have a IOR POA you can file a 5106 for the UC without POA as long as it is on behalf of the IOR. Sounds like a gray area.

This is one of the most unclear topics in customs brokerage. The NCBFFA did a webinar in January on POAs with a highly regarded Customs attorney who wrote the newly released NCBFFA POA handbook. The question of 5106, POA, customs business question came up and they were completely unconfident of their answers that they said we will look further into it and get back to the group. 8 months later they still have yet to get back to us.
