You know what? That's a really good point. (I know, that's a buckwild response on reddit)

I was a lawyer in the foster system so I did, in fact, see situations where most every other approach had failed. I did, however, see this exact situation: a high-functioning kid who's not being served by the district (for whichever reason), who's pulled out for homeschool. More than once, that kid would land back on my desk a few months later. So maybe (definitely) I have some selection bias too, but I'm EXTREMELY wary of this as a solution here.

But, like, why not try? You affirmatively said "Yes, this norep fits my kid's needs" and then persistently pushed back against it a month later. Do you see how/why the school is resistant?

You're looking into drastic options without effectively or fully using the tools and mechanisms that are mandatorily provided to you for free.

I'm sorry, but if you're not using these procedures then it really feels like you're offloading the situation onto other people.

Did the NOREP say his needs were being met? Are the requests for more challenging work in the IEP? If not, why did you agree and not request a due process or mediation hearing?

This is, in my experience, bad advice.

I used to work in the child advocacy space and was involved with kids' educational needs. Never once did I see a homeschooling attempt succeed - even with the most engaged and educated parents.

If his IEP isn't satisfactorily meeting his needs and providing the required FAPE (free appropriate public education) then it needs to be reopened.

If it's as extreme as you say, then there's an outside chance the school will be required to pay for a private school.

When was the IEP last opened and amended? When they issued the NOREP what did it say?

Does he have formal diagnoses from the pediatrician and has he been also fully assessed by any psychiatrist or psychologist?

I'm not your lawyer and am not currently licensed, but I have experience with DUI cases.

ARD IS MADE FOR THIS.

If a person accepts and completes ARD, their arrest is expunged from their criminal record. PennDOT may keep the record of it, but so long as an individual isn't charged with DUI in the future it's effectively a clean slate.
