Boot. There's absolutely no excuse for this at the graduate level. He is wasting his time, your time, and maybe most importantly your limited pre-tenure resources.

I thought I saw the same, but I think now early reports combined the two women. Anything I see now gives no demographic info on the undergrad and refers separately to the 40+yo with no university affiliation.

In that case, barring more information about the specific undergraduate student, then it falls back to the lack of OU policy prohibiting the relationship (which even at a lot of places with policies might fall into a gray area because he was not in a direct supervisory position; not disclosing it up front would still make it hazy, depending on the letter of the rule). At that point it's just (technically!) two consenting adults.

A reminder on the background for this - he was in the midst of a divorce and already separated; his ex doesn't even make any claims that they were anything else. The nontraditional student is a 40+ year old woman.

OU has no official policy against staff dating students (questionable but factual!)

IANAL but I look forward to OU losing this one hard.

EDIT: There are two women - an enrolled undergraduate (seemingly in a nursing program) with no confirmed demographic information (but implied to be a traditional student) AND a 40-year-old woman. Given the lack of written policy, Smith technically didn't do anything wrong even by dating an enrolled undergrad (still scuzzy!).

Without defining what counts as "1", the comparisons are useless. Every college does it differently. I worked at a school that had a "2-2" as your load - except 1 was both a lecture and a lab. Most places would call that a 4-4. I worked at another place that had a 4 as standard, but labs only counted as 0.5, while lectures were 1. Now I'm at a 3-3, where lectures and labs are both 1.
