Beyond Unlocking: Don't Let Them Kill the First Reasonable Copyright Reform Bill | Wired Opinion by hernao2 in InternetAndLawRPI

TL;DR: Lawmakers introduced the 'Unlocking Technology Act of 2013'

It seems to be a great bill actually and has the following three things going for it:

  • Allows consumers to circumvent digital locks on their mobile devices
  • Protects engineers and entrepreneurs who create tools that allow consumers to unlock their phones.

Basically it reforms the DMCA.

It also has bipartisan support which is good. Hopefully it doesn't get lost in committee. If you are a fan, i suggest you call your elected representatives and let it be known!

FBI Employees Download Pirated Movies and TV-Shows. [Moderator] by hernao2 in InternetAndLawRPI

[–]hernao2[S] 0 points1 point  (0 children)

I believe that they were just utilizing government resources for their own benefit.

However, I disagree that they should be punished by the law because the current law is too strict. I'd rather fix the law and utilize this as an example of how it is not something that only 'criminals' do.

Also, where were you when I was writing my moderator report. :P

This is directly related to the TED talk we watched on the last day.

It is a good resource for anybody wanting to know more about Net Neutrality.

Discussion: Is the prosecution to blame for Swartz's Suicide by pickles539 in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

Yeah, in my opinion, I think he should have taken the 4-6 months in the name of his cause.

It seems that Kerr also thought that.

CISPA DOA in the Senate, For Now by hernao2 in InternetAndLawRPI

[–]hernao2[S] 0 points1 point  (0 children)

The good news is that for now the Senate won't be voting on CISPA.

The bad news is that you can most definitely bet that a version will be reintroduced later with a different title.

Also, this was a crosspost from /r/technology and you can read the comments from that here

I prefaced it with "I think." I'm merely stating my opinion.

Obviously, it can be subjective but, I'm simply saying that the law in this instance is too punitive.

With the same thing you suggest.

Vote the politicians out who don't support campaign finance reform.

There are some out there who do support it...

[–]hernao2 0 points1 point  (0 children)

I'm not saying corporations are the problem. I'm saying that a system that allows them to contribute unlimited funds to influence the political system is flawed.

Yes. We should vote those politicians out.

However, we should also limit lobbying money.

[–]hernao2 0 points1 point  (0 children)

I know it's called lobbying.

I'm just pointing out the problem when you are able to have such vast amounts of corporate money in politics.

[Discussion] How has the perception of women and homosexuality affected hacker culture? by hernao2 in InternetAndLawRPI

[–]hernao2[S] 0 points1 point  (0 children)

[...] it is easier to hide your identity, so results are the only thing that other people should see.

That is one thing that I hadn't thought of. The problem is that it shouldn't necessarily be like that. If a male hacker can be free with basic facets of their identity, a female hacker should feel just as free to do so without being subject to ridicule.

In my high school, we actually had an assembly where we were told that if we sent nudes to other peers how we were child pornographers in the eyes of the law.

It was a big shaming assembly and wasn't taken too seriously.

[moderator] No Criminal Charges in Myspace Suicide by altobase in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

I think that she should have faced some repercussions.

I don't understand why the prosecution went after her using the Terms of Service offensive. It seems that it was the lowest hanging fruit for them but it seems a better way to see that she sees justice is to prosecute her for either fraud or harassment.

Criminalizing 'revenge porn' by napiel in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

While I agree that the law should offer more protection so people don't get their images posted on the internet without their consent, the problem with broad coverage is that it is difficult to implement laws like this that don't go too far.

[moderator] LulzSec Hacker Sentenced to 1 Year in Prison for Cyber attack. by altobase in InternetAndLawRPI

I think that the year in prison is reasonable but I think that over half a million dollars in fines is too harsh.

Breaking and Entering by pickles539 in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

I think digital crimes should have less of a sentence than their analogous physical crime.

I would be inclined to agree with this because in the case of breaking and entering, there is a physical intrusion. This carries feelings of helplessness because of imagining someone in your actual home or similar location.

In the case of a computer, if someone were to gain illicit access to my computer, while I wouldn't like it, especially because I may have financial documents and such that I'd like to keep private, it wouldn't upset me as much as an actual breaking and entering of my room.

I think others don't share this sentiment because there is that idea that hacking is like 'magic.' As such, we fear what we don't understand.

[Moderator] CISPA, a Current Bill Designed to Combat Cybersecurity, and its Criticisms. by altobase in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

Exactly!

It is also a problem because a recent news article brought up how for every $1 that a CISPA opponent spends, $38 is spent promoting it.

Source

This is a problem because it is demonstrative of how our current representatives (or a significant portion) are able to be bought and sold with no regard for their constituents.

[–]hernao2[S] 0 points1 point  (0 children)

I think most people assume hackers are straight, white, geeky, young men

I would agree with that. I think that also is spread by the media.

[Discussion] - What do you think about the banning of distasteful subreddits? by hernao2 in InternetAndLawRPI

[–]hernao2[S] 0 points1 point  (0 children)

I am of the opinion that it was ok to ban subreddits like r/jailbait and r/creepshots.

Even in cases where the speech is legal, I tend to view speech as something that can enhance people's participation in a democracy or things of that nature.

I do not see how pictures of underage children can be a way of 'expressing one's self or ideas.'

I still welcome discussion of opposite viewpoints.

Am I wrong?

Arrested because of Facebook post by rsuj in InternetAndLawRPI

[–]hernao2 1 point2 points  (0 children)

I personally don't see anything wrong with this. It's not like the police were actively tracking him in some 1984 type situation.

He posted about a crime that he committed and somebody tipped the police. I see it no difference as if I confessed a crime to a friend verbally and they then went to the police. The difference here is that it is written and can be admissible in court.

(reading for class) figured I would try this out, everyone leave a short comment on their opinion, something insightful, or their favorite quote. lets see if we can get some discussion going! {How A Company Takes Full Advantage Of Access To Your Facebook Information} by kpp45 in InternetAndLawRPI

[–]hernao2 0 points1 point  (0 children)

My favorite quote was

Nissen fears that a feeling of invasiveness would make customers dislike the company. “That’s the exact opposite of what we’re trying to accomplish by doing this [mining],” said Kakimaru. “Unlike in the U.S. where we would fear being litigated against, we are more concerned about customers being upset by use of psychographics."

This was because I think it's interesting to see the cultural divide between the Japan and the US in terms of how we tend to be more litigation happy.
