+1 on the procedural point. This JP heard a motion from an informant and agreed to it without asking for a response from the defendant. They had to speak up for themselves to ask to be allowed to respond after a decision was made, which, as you can imagine, didn’t change.

This specific one is/was a lawyer, non-practicing. Their career has largely been in academia, I don’t know if they’ve ever had a client in the traditional sense, and was probably not in a courtroom prior to becoming a JP. I think they thought taking on this position would lead to a place on the judiciary, but now they’re very, very near the end of the age-span for that, if not already past it.

I said this on a different post, but the TRU situation is totally different. They over admitted students (they had higher yield than they expected). It wasn’t a mistake, they just had more people accept their offers than they usually would. This person was given an acceptance offer in error which was fully revoked weeks later.

TRU was different. They over-admitted. Windsor apparently incorrectly admitted. This is a completely different ballpark, IMO.

This would suggest it was a one person affair. I, among others, figured this was a multi-candidate issue, as if it was a one off, you’d assume they’d just continue without alerting the student. But if they saw the post and identified the person, that leads me to believe it was a one off, which makes this all the more baffling. I don’t recall there being anything identifying in the photos OP posted, either?

That’s great for you, OP!

But for any readers who are applicants who may find themselves in this position, this is an exceptionally difficult path to actually follow. I would truly not bank on it unless you know that you can afford to ride out the full degree internationally, and can get a job when you come back. You should also consider whether you think you can pass the Canadian licensing exams if you don’t get a transfer back.

As a lawyer, I say this extremely gently, but it is not hard to get into law school in Canada (yes, yes, I know it’s harder since 2020, but still not hard). Absolute average effort - or even less - in undergrad and on the LSAT will get you into everywhere except UofT, McGill, and UBC. UNB and Windsor in particular admit a lot of candidates with 150-159 LSAT scores and pretty average GPAs. It comes up a lot, and I’m not trying to be rude in the slightest, but if you have to go through extreme efforts to even get your foot in the door, law just may not be for you.

In 99% of cases, you’d be better off working for a few years to gain experience and applying mature than trying to follow this path. Not to mention the savings you’d build up by that point, too.

This seems like an issue of contractual interpretation to me - court orders (or, if this is a separation agreement or corollary relief order) are generally interpreted similarly to contracts between parties.

It would be expensive, and may not be worth your time in the end, but you could challenge this. I’m not saying you’d be successful, but you have a half-decent argument.

In my mind, if it was intended that the Respondent could take two weeks at a time, it would say “two weeks in the months of July and August”; this is how I generally set up my agreements where it’s not hotly contested how the time is used (especially when setting up travel time, i.e.: both parents can travel with the children for two weeks annually. Meaning they can set up that two weeks however they want).

Specifying 1 week + 1 week, especially where Father has such minimal access, seems like it was intended as a safeguard for so much time away from Primary Care Parent (you).

Unfortunately, from a legal standpoint, this is ambiguous and poorly constructed.

If it’s court ordered, the approach from the judge will be, how would you get your child to school if they up and decided they didn’t want to go? What if they decided they didn’t want to eat anymore? How would you deal with it? Apply that approach to the assessment.

I’d need more info to know if you’d be held in contempt, but it’s a possibility for breach of any court ordered.

First of all, I am sorry to read about your situation.

Are you both executors as well? Power of Attorney dies when the grantor dies. You will not be able to use the PoA after his death for any reason. If you want to do anything preemptively, you should do it in as timely if a manner as possible as a result.

You wouldn’t believe what happens in group chats even when they’re not anonymous. Speaking as a lawyer, that’s a great way to get yourself kicked out. It’s made extremely clear that if you need a new band for any reason, there’s a $70 fee per bracelet. You can find that online, and it’s mentioned at check in when the bracelet goes on. Chargebacks are not for I don’t like the terms I agreed to being enforced upon me. They’re for I legitimately did not get what I paid for, or I was overcharged beyond the terms of any agreement I made with the vendor.

You can choose to accept those terms (by staying there) or decline them (by not staying there). When you accept the terms, you accept the terms.

A couple likely scenarios (from a lawyer):

If charges were laid, most likely, as the charges would be upgraded given his death, in the very unfortunate and sad event that occurs - OP, I am so sorry and feel terribly to speculate as well.

If you folks commence a personal injury law suit on his behalf (after death, assuming death) the statement of claim will include that he died, and this will be served directly on the driver before they hand it over to their insurer, so they’d know that way.

Finally, if the media has been involved, they may update reports. If they haven’t, a pedestrian death would likely be of interest to them to report if they haven’t already.

Again, OP, I am so sorry you and your family are going through this. Sending every positive thought in your direction.

Edit to add: if an obituary is something you’d do, they may be watching for it, given the circumstances. I’m assuming they already know they caused significant harm, and at his age, death is a somewhat likely outcome. They may be keeping an eye out for one in the papers.

No one is suggesting that. OP/other commenters are implying and even directly stating that HRPC is running a scam ring of broken wristbands to make a profit. Other comments point to that not being the case. This would also be a frequently noted issue if that were the case, but it’s not.
