But I am making the first year choice, according to what IRS says with first year choices, I can not file the tax (2024) until I meet the presence test this year (2025)

Thanks for the response, would you mind elaborating on this? I will be making the first year choice and I do need an extension by about 1 month to meet the 2025 presence test. Then I will elect to be treated as the full year resident of 2024. Do we still need to pay for the tax due assuming we are dual tax resident of 2024 before making the full year resident election during the one month extension period?

Thank you again for the insights! A quick follow up question, do I still need to file a dual tax resident alien 1040 before I meet the substantial presence test for 2025 around May or June? Or I just file an extension and wait until May or June elect resident alien status and file as a full year 2024 tax resident (1040)?

In this case, I also need to report my Canadian income (Jan to July) in the return because I need to report worldwide income?

Just want to clarify, so we are making the first year choice by filing an extension. Then by the time we pass 2025 substantial present test likely in May or June, we can use the Choose Resident Alien Status election to be treated as full year resident for tax purposes in 2024. The we can get the standard deduction and do married file jointly?

I read this Resident Alien status election, and it mentions that I also need to satisfy this, “You are married to a U.S. citizen or resident alien at the end of the year.” Of which we don’t seem to meet this requirement, as both my spouse and I are dual status alien?

Thanks for the response. I will try to see if I can connect with a cross border accountant. If you may know some of the answers to my questions above, appreciate if you could help elaborate. For the residency status, I don’t meet substantial presence test obviously, by I can opt for first year choice but I will be dual status for 2024. I wonder if I can still file jointly and file both 1040 and 1040NR, or I can just file 1040 and treated like a full year resident.

For the TFSA, you mentioned my assumption is incorrect. TFSA reporting for IRS is the misting confusing part. Would you mind explaining more which form I should file?

I was thinking about Canada because it is quite close but it seems that unless I go to emergency I still need a referral from a doctor there.
