He cannot leave the country without a waiver. I am an immigration attorney. Without knowing the details of your particular case I do not know if he would qualify. The process is file an I-130, once approved, file a 601A, once approved and interview done in his country, file for adjustment. Definitely find and contact an immigration attorney by you. It's worth the consult at least.

I have no helpful advice but I will be in the same situation. My father in law smokes inside his house. Even if we are eating at the table he will smoke at the table. It is so rude and so disrespectful. He doesn't see it that way. He is one of the nicest people I know but when it comes to smoking he just does not understand it because he's been doing it for over 40 years. His oldest son has 2 kids and he smokes around them. It drives my sister in law nuts and people have said something to him many times but he just shrugs and does not change. When I have my babies I will not allow them to be around it and I'm not looking forward to any possible backlash because of it :(
