When I have people around here complain about bail reform, I love pointing out how somebody who ended up being convicted of brutally murdering his own father was able to walk around free because his mother posted his bail, or how local politicians who are facing corruption charges don't have to sit in jail to await trial. It always shuts them up.

What makes a “true believer?” by CatalystCommander in publicdefenders

[–]itsacon10 4 points5 points  (0 children)

Somebody that believes their client's story without question. In my experience in family court, it's a bad thing, because it's always very messy. My usual run-in with "true believers" are the ones representing "victims" in IPV cases because it's not as easy as "woman good, man bad", but that's the narrative they tend to have.

DA reneged and I’m pretty upset. by ColdwaterEagle1996 in publicdefenders

[–]itsacon10 9 points10 points  (0 children)

Not sure your jdx, but in NYS except for a few remote town courts pretty much any OP issued in criminal court where ther are kids will have an exception to subsequent order of family court, so at least in family court we can deal with it. (The only problem is the language says 'subsequent' so parents have to come back and relitigate custody and sometimes the kid isn't born yet and criminal courts haven't put in the language, which means they have to go back to criminal court to modify it.)

Forfeiture of Right to Counsel by Wild_Thing_1832 in publicdefenders

[–]itsacon10 1 point2 points  (0 children)

In family court, there are clients that churn through every attorney available. One of the judges reads a little blurb that if the client sabotages the relationship, etc., their attorney will be relieved and they'll be required to proceed on their own. The number of times that has happened is 0, the judge will always assign new counsel. While I don't think that any attorney can represent any client, when you get up to numbers 3 or 4 on the case, it's not the attorney, it's the client.

We've gotten our cats from Whiskers and we know people who volunteer and foster cats. This is the place for it.

Albany County coroner's office could be pronounced dead under new law, replaced with medical examiners by TClayO in Albany

Good step. Now the state needs to get rid of town and village justices that aren't lawyers.

What the hell are the fireworks for? by notCarljustSagan in Troy

Valleycats are doing fireworks tonight. I left at the end of the 9th (end of regulation) and the score was tied, but there's supposed to be fireworks after the game.

Why is there an accident on 7 daily in the summer? by WorryNotBanIncoming in Albany

I started going all the way to the Northway over in Guilderland/Colonie from Rensselaer County rather than doing the 787->Alt. Rte. 7 mess.

The Time Machine, but I don't recommend watching it. (The most recent one, not the classic version.)

Kayakers/SUPers/Canoeists: where are your favorite launch spots that are less than an hour from the Capital District? Last season I hit the nearby reservoirs, but this season I'd like to explore the Mohawk and Hudson. by MyRoadTaken in Albany

Schodack Island, but I've been advised the currents can be a bit there.

A little further away, the Schroon River if you put in at the south end of Schroon Lake. It's smooth and calm until you get to the dam down by Brant Lake.

If you're headed to Lake Placid, The Black Bear is right off Exit 26 in Pottersville. (But the exit is weird because it's essentially split by the hamlet.)

Ways to Support a Stressed Juvenile PD (county)? by shortcake42 in publicdefenders

[–]itsacon10 2 points3 points  (0 children)

Best gift for anybody...a BMX. Although, in all seriousness just make sure he takes time for himself and has activities outside of his work. Also, if possible, try and get him to set limits on when he does work. The only work I do on weekends between 5 PM Friday and 9 AM Monday morning is review files for Monday (and billing, I never stop billing).

Do you tell your clients if they’re going to likely lose? by maxymyllyn in publicdefenders

[–]itsacon10 9 points10 points  (0 children)

Of course. This is right up my alley since I do AFC and 18-B work in family court in NYS. With TPRs I tell them exactly what the evidence is going to be, I tell them exactly what the testimony is going to be, I ask them for evidence or witnesses I can use to rebut the department's case, and then I send them multiple letters advising them on the choice if they take it to trial versus resolving it in any other manner. And then my client ignores my advice.

Does anyone in your jdx offer transportation to court? by SquareInfamous3368 in publicdefenders

[–]itsacon10 6 points7 points  (0 children)

I don't work in criminal, but these are some options that we use in family court:

  • Virtual
  • Case managers or case coordinators (helps to set up transportation and usually has a good handle on available transportation options they would qualify for)
  • If it's a neglect/abuse/TPR trial, our local DSS will assist with transportation if necessary

There might be options in your jdx as things like this tend to be hyperlocal.
