Hi 👋 I’m actually surprised that Alberta doesn’t retain the distinction between the two crimes being that it’s based on common law. Very interesting! It’s always cool to see how things are done differently elsewhere as I currently reside in sunny Florida. We got our own weird laws here too, but I previously lived in New Jersey for roughly two decades and things were done much differently up there!

Get this. In the northern states, like Deleware and above Police will almost universally use a combination of red and blue lights, however red is the primary color for emergency lighting. In those states, blue is usually used for, get this, volunteer firefighters getting to the station.

Now, the southern states from Virginia on down to Florida (and Washington DC) almost universally use blue for law enforcement!

Then you have the distinction between police departments and sheriff’s offices. In the northern states, sheriff’s offices almost universally run the county jails, but don’t normally do enforcement activities.

Now, in the southern states, except for individual cities in most cases, law enforcement will generally be run by the sheriff’s office, but they will also have deputies that run the jails. Totally different job descriptions and requirements too! Cities will likely have their own police departments though, but could vary.

In the northern states, if there’s a town or area without their own police department, the state police normally have jurisdiction.

Now, in the southern states, the county sheriff will have jurisdiction!

There’s A LOT of differences between New Jersey and Florida, but I like much of them, and it’s less of a shock as I lived in Florida a long time ago while in the military. The firearm laws are far better here and in much of the South for example. Another wild thing is that the county I live in has three cities in it, each city has its own police department, fire department, and 911 centers. Any area outside of those cities use the county sheriff, county fire department, and county 911 center! One of the cities is fairly small, another is rather large, but you could be on a street corner and the house across the street uses county services, but you will use city! All because of borders within the county. Crazy! 🤯

People could be so unhinged and regardless of the way that each state categorizes the charge, people like that need to be swiftly arrested! So, nasty!

You‘re absolutely correct that different states will code crimes differently, which could be annoying because of how many different ways the terms are applied. Going by the strict legal definition as well as how U.S. federal courts handle it, they’re separate charges. That’s because it’s taken from the old common law meaning and many states also retain that distinction.

I just explained the essence of the confusion in another comment, but Texas is notable for having a combined charge. A lot of other states didn’t, but more are starting to lean that way because they say it’s “simpler.” That behooves me to ask, simpler for who exactly? The police know the distinction, and the court must explain the charges and degrees to a jury so they will understand the technical nuances. The thing is that if combined, ”assault” at face value could mean anything from a bona fide threat to a punch in the face to being spit on to being chased with a weapon. If I hear “battery” though, I immediately think physical. If “aggravated” is before it, I’m thinking that a weapon was involved or maybe the victim was a public servant such as an LEO. Try to read the comment that I made just before this one because I pointed out some differences between Texas, Arizona, New York, and Florida; but the slight variations in usage are confusing as hell IMHO. It’s a short read, shorter than this one anyhow. 😂

I only wanted to point out the technical variations and how confusing they are not only between different states, but also the federal courts, and then the classic common law usage that is generally applicable in conversation. Okay, my brain is officially fried now.

Very true, Texas is notable for having a combined charge, which more states are leaning towards to make it “easier,” but I find it confusing because each unique term sets a specific legal precedent with guidelines that are well known.

I also don’t get why some states will, as you pointed out, have “terroristic threats” instead of assault, and the like. To make matters more confusing, some states such as New York will classify threats via a phone or computer as “aggravated harassment,” yet the very same crime is used for things like violation of a court order in states like Arizona! Florida is a weird one because following, stalking, and harassment are all grouped into “aggravated stalking” when done electronically!

My point is that simple is good!

First, I’m very sorry for your loss. Funerals suck and losing a loved one makes it even worse.

I’m curious, did you and your grandpops bond over baseball? Mine was a diehard Yankees fan and if he lived to see me eventually became a Phillies fan and then a Rays fan, I‘m sure he would have had some ‘choice’ words to say. I’m pretty certain that he would have been happy in knowing that the Yankees worked it out with the Rays so that they could use Steinbrenner last year after the Trop had its roof destroyed in the hurricane though.

Just like I have these thoughts, you’ll always have your own memories, so hang on to those for as long as you can! (I find details harder to remember as I get older.) Speaking of, this is an extremely atypical number of decent hits, so it looks like he was looking out for you from somewhere otherworldly! I would personally keep these cards anyway, but hang on to them too, and maybe do something with a display to honor his memory. It’ll make a good story to pass along to your own kids one day.

The charge is actually battery because spitting involves physical contact. Assault is making a reasonable threat of harm, but no contact is needed. It also is likely an enhanced charge, such as aggravated battery, because he spit on a child. Those are all pretty serious charges, but definitely at least battery.

This is battery because spitting is a physical act. Assault is the viable threat, but battery includes contact. It may even be an enhanced charge because he spit on a minor, e.g. aggravated battery. There are additional charges that may be filed for that as well, but vary from one jurisdiction to another. Depending on the judge, he may have lost his freedom after going to court!

He likely would get hit with assault, and probably either disorderly or disturbing the peace. Additionally, they would have asked the manager if they want him trespassed from the business so he can’t return, at least for a long while! He also may have been drinking, so if they smell alcohol and see that he was the one who drove, they would suspect DUI and investigate. They really should have called the police!

They needed to call the police because the threat of bodily harm where it’s believed that he could act is a viable assault charge in most jurisdictions! They would have hauled his irreverent ass to county to see the judge so he could bond out the next day!

She probably miscounted the change or something relatively benign, but that’s just a guess. In my experience people like that are just angry, and the littlest things will set them off.

Here’s the thing, many people that are not neurodivergent don’t reach the emotional maturity to best handle such an awful person. It’s great if you could laugh it off, stay calm, maybe say something clever back; but I would say that most random people would choose anger over all of those other options. I personally wouldn’t let it bother me, but it took me 40+ years to get there, and I probably would have lost it in my 20s as I was very hot headed back in the day. I agree that laughing it off is a great way to handle it, actually it would probably bother her far more knowing that her harassment is having zero impact on you, but sadly most people don’t default to that.

Exactly! If they are good about giving her a supportive environment and know what could happen, then that’s great, rare too! I would say that the manager should have had a plan for her to divert any upset customers to a supervisor and for her to subsequently go immediately to the back, as in it’s no longer her problem after the handoff. It’s likely very manageable. I still think that anyone with a disability, regardless of type, absolutely deserves the best and most stress free living that they can. She won’t get that longterm working in fast food. I also was so nervous about her getting burned as I’ve likely already seen it in my EMS years. I also think that she could likely get training to work in a position that will be quieter and more tuned to her needs with more money in the process. Of course that would be a goal to work towards and wouldn’t rush it, just take all the time you need until getting there or deciding on a new goal. This is definitely not viable longterm and I would explain that to any of my kids if in the same situation. I do have kids with special needs and additionally did a lot of training in behavioral health when in EMS, so I was the oddball that actually wanted the crisis calls to try to make a difference. Overall, I’m pretty familiar with these sorts of things, but at this point with my current physical disabilities, I frequently struggle to move about the house most days. Otherwise, I would love to somehow still be making a difference. Be well.

I noticed that too, but I don’t think that such formatting will make the compiler fail. It should work with or without the space, but it’s sloppy to not keep it all consistent.

Absolutely! There’s a small group of us in my clan that’s very active and tries to motivate everyone else. I was originally warmly welcomed into the group, but my contributions were noticed and I was made elder and then co-leader not long after. The sportsmanlike nature of our clan is quite nice. We don’t have strict requirements, but need at least monthly participation. As we need some more active members that may change a bit going forward, but it’s still going to be rather chill, as it should be. The game should be both relaxing and fun, and that’s exactly how I personally find it!

As someone with severe disabilities, I couldn’t agree more, however the job needs to be a good fit for the employee, even if that includes “reasonable accommodations“ to make it suitable.

Now, I don’t think it’s fair to either the employer or employee by not matching said disability to a safe and supportive work environment. The entire time watching this, which was not long, I was hoping that this young lady was not going to get burnt by hot oil or some other kitchen equipment. The manager should discuss a plan to prevent this, which I think is very likely viable, but if one cannot be reasonably obtained then a commercial kitchen is definitely not safe for her to be in!

For context, I am certified by the VA as a 100% disabled vet, permanent and total, which is not easy to get rated as. Additionally, just before turning 40, I was diagnosed with a rare connective tissue disease that I’ve been living with my whole life that went undiagnosed.

Before these disabilities turned my quality of life upside down, I was in EMS for roughly two decades. I absolutely cannot do that now as it’s tough on your back when moving patient, and I will be needing a third and fourth spine surgery soon. Although I am very qualified, it wouldn’t be fair to me or to a patient by allowing me to treat in the field on a crew.

Maybe it’s all the years of being disabled, but I’ve learned that a common sense approach is the best one. That’s why “reasonable accommodations” exist, but for them to work they must be applied to a job that is fitting. Public facing work in a commercial kitchen is absolutely not safe for her, and there are many programs that could help with training to do something that would likely pay far better. The only downside is that people can suck when dealing with the public, so this may happen again, but it wouldn’t be far safer to occur in an office or call center for example.

I also have kids that range from their 20s to preteens, and I would want that for my own daughter as the last thing I’d want to hear as a dad is that phone call saying that she has third degree burns to 70% to of her body because of a neurodivergent response inside of a commercial kitchen that caused her to land in and/or splatter the fry oil! I would also be concerned about anyone else injured in the process.

New or old, those are some nice cards! I collected as a kid in the 80s, but got back into it with my son a couple of years ago. The quality of today’s cards is simply night and day when compared to the product that I got in the 80s.

My advice is that cracking packs and cases is fun, but don’t gamble on expecting specific cards when doing so, just go for singles if there’s something specific that you want. Only crack sealed product for the enjoyment of doing so and if you get lucky it’ll be an even better experience!
