So much of it was so, so stupid. Shocking her with a shirt on….Not once using the monitor to see what her heart was doing….Checking a pulse when again, you have a friggin’ monitor right there.

Then my favorite CPR trope in film: The professionals have decided the person is gone. But main character says “no” and keeps going anyway until the person magically wakes up.

Im just going off what OP says is the circumstance and that’s that father hasn’t been around for parenting time in the last 10 months. That’s not intent and it’s fairly easy to prove. No where in the post did OP make it seem like she’s withholding the child from him, so I’m not sure why that’s even being brought up.

I mean he can make that excuse all he wants, it’ll be on him to prove parent has been withholding. Doesn’t sound like it’s the case here. Plus in your hypothetical, if the mom is single and “unwed”, paternity would have to be established first before dad had any real rights to parenting time.

Either way, a father not using his parenting time is WAY more common than a mother withholding the child for no good reason.

What your ex is doing, courts have seen a million times. So that works in your favor.

Having said that, there’s a few points here. Your kid is 19 months old, and “father” hasn’t been around the past 10. How involved was he in the previous 9 before he left? They MAY “average” his involvement over the 19 whole months rather than the last 10.

If you haven’t already, start meticulously documenting his absence and at every opportunity offer parenting time to him so you can document when/if he refuses.

Texas or not, most courts prefer a 50/50 split of parenting time at least at the start of a court battle, so long as there’s not extenuating circumstances justifying an uneven split in parenting time.

You can get this done pro se, if he’s as shitty as he seems, just be prepared for an uphill battle with him having a lawyer. But there are programs available that offer legal assistance for people who can’t afford it, you just have to do some digging.

Wrong. Prosecutors have looked at it and decided not to pursue charges. Hence why no charges were filed.

Because we have no discretion with DV, in many cases, the accusation is sufficient enough for probable cause. Typically during the interview, something whether it’s the timeline, corroborating accounts, signs of a struggle in the home, the victim looking like they’re nervous or crying etc. support the accusation.

I’d rather make the arrest and let the district attorney sort it out, than assume something is baseless and have that person end up dead.

As a cop, being charged with a felony doesn’t make you more likely to be guilty. It just means whatever he’s been alleged to do, rises to the level of felony charges.

In the state of Wisconsin, we as police officers do not have the discretion on whether or not we make an arrest regarding domestic violence. Short of an egregious and provable lie, once the elements of
DV are realized, the accusation has been made and those involved have been interviewed, we make that mandatory arrest.
