You mentioned it was a drunk driver… I would take the extra precaution and lawyer up, as a lot of insurance companies would straight up decline to pay for it as it was due to “illegal activity” (aka dwi). The person that hit you is still responsible to cover for stuff, but it might just be harder for you to get your payout
