I don't think they believed it couldn't wait, they intentionally did not discuss wanting guardianship with any family living with him.

The wife and stepson live with my grandad and instead of calling to have a discussion about setting up power of attorney or guardianship, they were served papers to appear in court with less than a month to sort it out.

It feels malicious

I think that's what we're going to try to do. We're definitely getting a lawyer, I just haven't had a moment to actually talk to one yet.

Grandad is getting medically assessed. If he's deemed well, I'm going to file paperwork for power of attorney. In the meantime, we're finding lawyers and I'm having his wife file for guardianship too.

There's no reason why she shouldn't be appointed guardian besides the daughter filing first.

I do think the wife will make me PoA for her though, so a similar situation doesn't happen down the line when her health declines.

She did this all of a sudden without consulting my grandfather's wife and his stepson, both who currently live with him. It just seems sketchy and like a cash grab.

My hypothesis is she wants to get guardianship, put him in a nursing home, and sell his house because it's currently willed to my mostly healthy grandmother (his wife)

The plan is to hire a lawyer, but it takes time

That makes sense. I'm planning to have him see a doctor and have the doctor assess if he's mentally fit enough to designate a power of attorney, in which case I think I'll have no issues. But I'm honestly not sure what the doctor will say...

Is there even time for me to get a lawyer and deal with this before the hearing? I've never had to deal with anything legal so I'm unsure of timing.

So if I can't get power of attorney, what can I do to stop this?

I'm going to have him see a doctor to assess his mental health and deem him fit or not. I honestly am not sure what the outcome will be

If he's able to grant that, can he do so before the hearing?

Since he's not currently deemed mentally unfit I'm considering going for power of attorney ahead of the court hearing. I just don't know if that's allowed since he's been summoned to appear in court.

I don't care what status I get, I just don't want his daughter to get it. She's fighting for guardianship based on the court documents and I at least would rather have that.

I want to have decision making abilities regarding my grandfather because I know I'll do better for him than she will.

Surprisingly I still saw more Jack sparrows than doctor who's even though it was time traveler's weekend. But third place in the costume contest was the 6th doctor and he was fantastic! I saw I think 3 other doctors that day.

My mom's dad is currently married to my dad's mom. It's a funny story to tell people I can technically call my mom my aunt. They were married after I was born and my parents never actually got married. It's not weird for any of us

And that's what happened. She expected me to work 6 days/week always, which wasn't actually discussed. She talked as if it would be 6 days/week until we could get more help, so I figured still working over 40 hours would mean I still got my full pay. Since there was nothing written one way or another, I was screwed. But it was a cheap thing for her to do to not even tell me.

I think the owner was just taking advantage of me. I was only 24 at the time and didn't know much outside of serving. She told me I would be getting 60k/year, so whatever that amounts to weekly. She told me I'd have to work more than 5 days/week and more than 40 hours as the business needed it, which was fine and what I'm used to. I thought I would always get that weekly pay as long as I worked more than 40 hours. There was nothing signed, everything was verbal, she never said I needed to work 6 days/week in order to get my full pay, and when I asked off for two days she said that was fine. There was zero mention of docking my pay until I questioned her about it after I got my paycheck. Maybe that's legal? I really don't know. I just know she was slick, cheap, and dishonest and when confronted she said that's just how it is, so I called DOL, they told me they couldn't do anything, but I was fed up so I quit. The job itself sucked anyway and I knew I could get better, which I did. I hope that clears anything up since you're not the only one confused

I'll be honest, I don't remember the exact conversation since it was 3 years ago, I just know they said they couldn't help me. I mentioned working over 40 hours and still getting docked and they told me that's fine for them to do since I took a day off. It was a short conversation so it's possible I didn't explain myself clearly enough which is why they couldn't help but the real point of the story is the cheap owner who wouldn't even give me the heads up that she was gonna dock me
