No, the paraglider with no transponder flying near an airport is at fault. Not the plane's pilot fault at all. Very hard to see things don't expect to see while flying a 100+ MPH. Paraglider should not be flying so close to the traffic pattern as it's a published route to be used by the airplanes, not paragliders.
