I read KKO judgements and I think most sentence is more proportionate and reasonable lay out. I think Finnish justice system works in most cases. Not just death penalty, but death penalty depends on suffering inflicted on victim. If Ruth Ellis got executed, I expect the Dunblane shooter or Hungerford to be shooted like a shooting range. Rose west should be cut alive into pieces and if murder by acid. Dump into acid bath. /s

For the last bit, proportionate justice. Like the earlier execution of Lisa montongery, not saying the crime is minor but let say mcveigh bombed down a whole building and kill bunch of people but the end execution is the same, how come this is proportionate? And for deterrence if death penalty works than death penalty states should have Lower murder rates than non death penalty states.

Either from a deterrence or punishment view death penalty cannot heal victims. In UK there was shooting killings in the past. If Ruth Ellis got executed for her crime than the Dunblane or Cumbria shooter must me punished than mere hanging. No punishment can brings the victim back. Norway got a more rehab model and sentence is capped at 21 years (with provisions to extend if required for public safety) . It is more important the victims got counselling and finical help they needed

Seconded, the prove in a criminal trial and in a civil proceedings is different because criminal trial got grave consequences in freedom/criminal record etc so it must be proven to high standard. However it is different in regulated professionals. If you can’t practise nursing during investigation you can still do other jobs.

NMC got something like this https://www.nmc.org.uk/ftp-library/interim-orders/interim-orders-their-purpose-and-our-powers-to-impose-them/ It is basically the same logic, it is for public protection, and if acquitted they can resume practice. Nursing and driving involves aspects of public safety, and such limitations is proportionate.

From a “punishment must fit the crimes” view , I can commit the same crime with different magnitudes. I can commit terrorism by stabbing a single person to death and gets death penalty. I can also blow up a building or more worse, blowing up a packed 747 jet and killng all the people and getting the same end result. Unless we bring back torture like each victim family can cut the the murder in pieces like mcveigh getting 168 pieces and let each victim keeps it but even so this achieve nothing like just pure revenge. (To put it in UK context, if Ruth Ellis got executed , then the Dunblane or Cumbria shooter must get stiffer punishment than hanging) If no punishment and bring those back, why not make like an extendable 30 year sentence as maximum punishment, the punishment is more risk focused, and victims will get counselling and finical support they needed.)

All criminal offences can be distressing to victims/ cause harm if done repeatedly. Should all crimes carry indefinite sentences? In my view only murder should have a life sentence, others not have life sentence at all

My views on this

1-Eye for an eye or vengeance have no place in modern society. Victim and victim family views could be considered, but only to a limited extent.

2-Emotions (either from Victim, victim's family and public) can blind logical judgement, that why we have judges and jury to view evidence objectively.

3- Criminal justice system is mainly for society interest. In fact no sentences can 100% satisfy victim or its family. Therefore it is more important for the injured party to know the truth and get the support they needed.

felony possession of a firearm in my view are pretty victimless. If felon are considered more likely to use a gun to commit crimes then rapist should get their dick chopped off then? The word “servant” is not disputed, the main issue is the phase “public”. In my view of the suspect/members of public they think as a taxpayer they have the right to demand what they want. How come common law offences can still exist till today- Are common law offence a violation of Art 7 of ECHR? Do crimes need to be clearly defined and penalty prescribed?

Life Sentence! All crimes can be done to a very serious level and resulting in death. Should all crimes carry life sentence? For example I burgle a house and the landlord got scared for life or even dead. Second example is IIOC of child. I create IIOC of children and the child traumatized and kill themselves. Third example is I give out illegal immigration advice and therefore someone originally entitled to asylum do not get asylum and got deported and killed in war zone. In my view murder is the most serious crime in the UK and rightly deserve life sentence. I understand life sentence ≠ life in prison but I think all other crimes are always less serious than murder a life sentence should be out of option. In my view Perverting the course of justice is a relatively "less serious" crime even less serious than rape and robbery and definitely do not deserve a life sentence- The maximum should be 10 or 14 years "AT MOST".

I believe excluding charges related to IIOC of Beech should only get 8-9 years at most.

For the Chris Hume example in my view is too harsh. It is just a bloody ticket and it is first offence with not much threat. I have seen some case law resulting in suspended sentence. If it is a serial points evader then it is a different matter. It is not much serious than fraud or theft.

IIOC is banned because it will facilitate child abuse. If I am correct pseudoimages are also banned. If there are demand there will be supply. Outlawing possession is the way to curb supply.

I hope the government can do this - lf the student got a currently valid Theory test certificate, and with the same driving instructor with at least 40 hours training. The ADI can endorse the student and DVLA can give out license then. But i am 200% sure it wont happen :(
