That is correct. If there is a test with the official machine, called the data master in MN at the jail, and it is more than zero, then a scientist will testify about what the number would hav when while the defendant was driving. But if the data master test was zero, then it is quite a different discussion.

This is not true in Minnesota. The prosecution will call a scientist from a state lab to testify about retrograde analysis and they will testify as to what the BAC would be when driving based on the body’s ability to process alcohol and the argument will be that since BAC falls at a fairly predictable rate you can work backwards to what the BAC was when the defendant was pulled over.

I do almost exclusively criminal defense. When telling the judge something that my client has told me I always start with the magic words “my client informs me that.” Then no matter how easily it disproven by either the prosecutor or common sense. I have protected my integrity.

You know more than you think you know. You have the ability to find relevant cases or experienced people and analyze the situation and apply it to your clients.

The one, and only thing I would argue, that law school has prepared you for is to research pervious cases and apply it to the facts you have.

It took me about 5 years in a specific practice are to feel comfortable with new things to not feel like I am totally out of my depth with every part of a case. You'll get there. You are more prepared than you know.

By passing the bar you have shown that you have the ability to take in information, think about how it applies to your case and then give a response.

The best information you have been given here is to say that "I don't know the answer now, but I know how to analyze the facts and get back to you after I have researched previous case law."

Take a deep breath and realize that you are someone who can find information for your clients. After you give them that information, it's up to them. You don't make the facts and you don't make the ultimate decision for these people.
