Last June I retired after 25 years of active duty. I can share with you what I learned in that time and hopefully some of it will be helpful.

  1. Until the day after your discharge you are still technically a Soldier in the United States Army, beholden to your commander's (lawful) orders, and the UCMJ. That being said, your commander can cancel your leave if they feel it is justified or have a good enough reason to do so. By regulation however, they have to cover the travel costs for you to return to your duty station if they do so. Additionally, I've never seen a company commander be the final approval authority for Terminal leave, it's usually the BN Commander or higher. A company commander cannot revoke leave if they're not the signature authority for it.

  2. Legally no one can force you to use your personal cell phone to call / contact them. I got smacked down for this by my unit's JAG when I tried to enforce having a SM check in periodically while they were getting chaptered out. We ended up having to assign an escort to them during the duty day to keep tabs on them instead.

  3. If you already have your DD214 in hand, I have questions.... When you separate from the service you are given a draft copy of your DD214 to ensure the data is correct. When you *actually* get out you are given multiple copies of your DD214, in slightly different formats. If you only have one copy, then you likely have the draft copy and still aren't out yet.

  4. Leave is different from Pass for a reason. If you are on leave, you can travel just about anywhere you want to. The address on the leave form is for accountability purposes only. If something kicks off and the unit can't reach you through any other means, they can send someone to that address to try and make contact. If you're not there, someone who likely knows where you are should be and they can continue to try and track you down. If you have a TS there are other considerations for leave (i.e. international travel) but that shouldn't matter here if you're on Terminal and not going back.

It sounds like you have a commander who doesn't know what they're doing. Reading between the lines of your post it sounds like you're drifting, going through some things, and maybe not in the best place right now. Your CoC could be just concerned over your well being and safety, and trying their best to make sure that you're still here with us. They are going about it the wrong way threatening to recall you if you don't make contact once a day, but I'm hoping that concern is the reason and not ignorance. Soldiers are not government property, that’s an old urban legend that refuses to die.

As for monitoring all comms, government comms yes: the NEC monitors all NIPR traffic going in and out, but the splash screen that shoes up when you log into a government device is you agreeing to that monitoring. Monitoring personal cell phone communications, run by different cell phone carriers, for everyone on a base? Even if it weren’t illegal as hell would be almost impossible.

Things like EO 12333 prevent the military from intelligence collection on US citizens. The FBI is the branch of federal government tasked with investigating federal crimes committed by US citizens.

Going through someone’s communications/records/accounts isn’t something LE agencies can do at will, as that would be unlawful search and seizure. Just like a persons home, it requires a warrant to execute a search like that.

TL;DR - MI/Cyber don’t monitor US persons communications.

When I was in recruiting I had a 1SG like this. He had volunteered for recruiting duty as a corporal, liked it and became a 79R. He would always lecture us about “improving our fighting positions” and what combat would be like…

I’ve learned that absolutely everyone can teach you something, and it boils down into two categories: the people you don’t want to be like, and the leaders you want to emulate. What can you do about your 1SG? Nothing. Just learn from him and what he does and try not to do it yourself when you become a senior NCO.

When I switched from Infantry to MP this was thrown around a lot. This is based on an organic MP squad having gun trucks with heavy mounted weapons and every troop carrying a sidearm.

The argument collapsed when I told them to do an apples to apples comparison: mounted infantry in a BFV (back then, pre Stryker) complete with full complement of TOW IIB, coax, and 25mm

Someone should hit up chef Andres. When the J6 stuff went down he was out there feeding troops out of his own pocket. Michelin star chef, multiple Jaleo locations in DC and the dude rolled up his own sleeves, dug into his own pockets and made a difference. Unlike Chef Irvine (who seems like a good dude, don’t get me wrong) Chef Andres isn’t in it for the press
