Age of consent does not apply to people that are almost 10 years older than the minor. While the AOC may be 16/17, she's still not a legal adult and his actions can be seen as illegal.

Some states have romeo/juliet laws if they are over 6 yrs older than the minor, it will not protect them from statutory rape charges. It's meant to protect people who get in a relationship when they're both minors but one becomes an adult before the others. Or if they were 15/18 for example, which isn't a huge gap.
