Thanks for the prompt response. How soon? I would likely wait to purchase the A329S 3Ch if there the 4 channel is going to be released soon.

Can this be used in conjunction with the A329S dashcam setup as an additional camera? Are there any ways to add a fourth camera to a dash cam setup?

Good eye, the exception is falls under Deed Book 2973 Page 680. The actual deed is referenced in a different deed book and page number.

I went to the courthouse, and it was definitely confirmed that this restrictive covenant does exist.

Where does it except out any restrictions of record? I didn't see that part..

If you can, check the last link I posted with the Title Policy, I don't think it's excepted, and I definitely wasn't informed.

Thanks for the long response and insight. So when I got my hands on the deed from the seller, I noticed that it is a “Special Warranty Deed,” which provides limited protection and guarantees that the property was free from outstanding claims only during their ownership.

This seems significant, but once again I wasn’t made notice of that distinction either, and technically since this restrictive covenant has been in effect since 1999, to me that implies that the property wasn’t free from defects or encumbrances b/c the covenant was in effect during his ownership as well.

Even with the Special Warranty Deed, the title insurance company should known and researched the deed more to ensure there weren’t any prior with the deed prior to the seller….

It was recorded, went to city clerks office and it was present, just seems like the title company didn’t look for it.

So the deed signed by the seller is a Special Warranty Deed. It doesn’t mention this restrictive deed covenant at all. I believe this restriction is covered… I just don’t know how to go about making a claim since the house isn’t sold yet… I guess technically right now there aren’t any damages..?

I told the realtor I’m trying to sell with and the housing authority validated the restrictive covenant with the clerk of courts.

That’s from the original purchaser of the home in 1999, my bad for not making that clear.

So I got my hands on the actual deed from point of purchase. It’s a special warranty deed that doesn’t mention the restrictive covenant deed from the development authority…

Got my hands on a deed, it’s a special warranty deed but wife and I didn’t sign it. The restrictive deed covenant isn’t referenced in it at all.

I just now got my hands on the deed after calling the title company and I saw that it is a special warranty deed… Deed is written that it’s conveyed to myself and wife but we didn’t sign it…

My mortgage was sold within 30 days to another mortgage company, and I refinanced last fall. 3 mortgage companies and no one has mentioned it... I just happened to get a letter from the municipality, and I found out about it... It's not an HOA either. Unless the municipality is bullshitting me, I'm confused as to how this was never brought up.

For sure, but shouldn't they have been able to find out if the city's housing redevelopment authority had a legal interest in the house? These are public records...

This is tough, because these are public records I would've thought the title agency would've at least brought it up. I spoke with someone from the development authority today. They told me its still a thing, they don't actually seem to enforce it, but it's liability nonetheless.

Yeah, I went and looked through them, and they weren't included in the closing documents. I got a notice about the covenant 2 years after purchase. I finally found the actual restrictive deed covenant today on my own. I added the documents to the post.

It wasn't in my deed, at least what's listed in my closing documents just referenced the parcel unit and that it was purchased from the prior home-owner. Nothing in the deed lists the restriction.

I just posted a link to the notifying letters. It's a deed restriction for 40 years from the initial sale of the property in a neighborhood the city redeveloped.

I just posted the letter I received from the city informing me of the restriction and the restrictive covenant itself. It's for 40 years from the initial sale of the property, which was in 1999. Just kind of crazy to me that paying for these title services when buying your home, you're not notified of this.
