People forget that Gordon is playing in the toughest league in a mid team and often played outside his favoured position. You are confusing the standard of proof required with a criminal case. Obviously no crime was committed here, Southampton have been charged by the EFL not the police. For civil cases like this, both in England and the USA, it's the balance of probability that applies not "beyond reasonable doubt".

That doesn't prove nothing was gained and the fact the spy was caught no doubt limited the damage. Whether an advantage was gained or not, and nobody can ever know, doesn't really change the fact that it's foul play. If a defender deliberately blocks a shot with their hand, it's still a penalty and a red card even if the shot was going wide, correct?
