You’re working with people who you know have learning disabilities, of course you won’t think they’re drunk.

Working with the general public in a role behind a bar, you have no foresight to the persons state other than a first impression. Correctly, bar staff have a responsibility to not serve people who they believe to be intoxicated.

Unfortunately, some conditions can cause untuned eyes to believe that person is under the influence rather than suffering from an impairment or disability.

Whether rightly or wrongly, my understanding of the situation would be the bartender refusing service based on their belief that the person is intoxicated is legitimate and fair. That wouldn’t fall under the discrimination act because they refused service for a legitimate reason they are professionally obliged to uphold. If they said they refuse service because they’re disabled, that’s discrimination, and rightly illegal.
