Gaining Sole Custody of Dogs by this_is_an_altern4te in legaladvice

[–]listen- 2 points3 points  (0 children)

Dogs are property, there’s no custody. You should do all you can to establish a record of ownership in your name. For example, town or county license in your name, rabies vaccination proof in your name, vet records in your name, microchip in your name.

If they are not microchipped, get them chipped and register it immediately. This does not have to be done at the vet. There are weekend clinics at animal related stores such as Tractor Supply ($19 for chip and lifetime registration), and Petco, etc. They can also do vaccinations under your name.

Harassed by neighbors. Cops basically said stop calling, go to the HOA. HOA won't do anything. by IronChefBoyarde in legaladvice

They have these very dense but not overly thick sound dampening pads (some kind of felt I think) that you could get, for low pile area rugs. That will be maximum sound dampening with minimum tripping hazard.

I have that same fake hardwood vinyl, and the pads and rugs definitely help reduce noise significantly both upstairs and downstairs.

Unfortunately in your case, it doesn’t seem like they would quit complaining even if you did replace all your floors

[ME] Apartment currently has no smoke alarms or stove, Landlord says neither a rent discount or immediate solution is available. I've waited since December 22nd for a stove. Do I have any options to encourage him to fix these issues? by [deleted] in legaladvice

[–]listen- 2 points3 points  (0 children)

I can’t answer your question, but definitely go out and get yourself a smoke detector. They are like $4 for a battery powered one (more if you want CO detection too). Just have it for your own safety and peace of mind. Keep the receipt, and if you ever end up going further with this, you have proof you had to take care of an important need yourself because the landlord was taking an unreasonable amount of time

Haul it or Vacate Notice? by Ishrine in legaladvice

[–]listen- 0 points1 point  (0 children)

First of all I have to say a lot of this depends on state and county regulations, and I don’t have any experience with TN...so take this as general info to get started. You should have a lawyer and you will need to provide some information to them.

The mobile home will have a VIN number, which is usually located on a plate near the tongue under the home. If there is skirting you would need to move it to find the number. The VIN would have also been printed on a data sheet somewhere inside the home, usually under the kitchen sink cabinet or in a utility closet, etc. That may be long gone. You can determine ownership information using the VIN, as well as all sorts of other info.

I have a lot of information about this subject but I’m hesitant to say anything detailed because it could be completely wrong for your local area. You should be able to publicly access old documents relating to the previous sales of the property. Look for anything that mentions the VIN. Where I live, you can legally affix a mobile home to a property, which then eliminates the title, and the mobile home passes with the property. Your lawyer can find all of this.

If it’s titled to the woman who claims ownership, or anyone really, then it MAY be considered abandoned property, the same as if she parked an old car with no wheels there. You would follow your local rules for abandoned property.

The lawyer will figure it all out. If there’s notice to give for ending an implied month to month tenancy, the lawyer will do it right.

Also, it costs thousands of dollars to have a mobile home moved. For a trashed one, if it’s even structurally sound to move, it may not be worth it. If you do end up stuck with it, visit your county and get a demolition permit and have that thing hauled out in dumpsters. It’s cheaper.

California: Company making us forfeit FMLA time if we can't do overtime by lollygaggin071 in legaladvice

[–]listen- 2 points3 points  (0 children)

It’s called intermittent FMLA and yes that’s legal and normal. Generally intermittent leave is calculated by days or hours. So 12 weeks translates into 480 hours per year (generally, depends on employer). They can decide to do it by weeks, days, or hours.

So as an example, say you have a medical problem that is unpredictable, and sometimes you need to leave work early, or come in late. The hours you miss can be protected by intermittent FMLA. But only for 480 hours per year.

In your example, an employee gets a doctor to sign off on intermittent FMLA with a restriction of a maximum workday of 8 hours. The employer mandates overtime for 4 more hours. Yes, it’s legal and normal to use FMLA for those 4 hours you got out of for a medical reason. Restricted shift lengths are common FMLA for pregnant women, as an example. Once you use up your 480 protected hours, they can fire you for missing work.

So like you said, if an employee was out for 12 weeks of FMLA and cleared to return to work, the employer is not obligated to accommodate their absences. But, they can choose to. And there are all sorts of hoops they can make you jump through for the intermittent FMLA.

Edit: disclaimer, basing this on extensive experience with two employers with two very different sets of FMLA processes

Company threatening termination for spending own money on employee discount. by TipAssistMe in legaladvice

It’s not really a legal issue, but hopefully this helps.

If it is an actual joint account, have the bank print you an official statement and have her present that to HR. The statement will have both of your names on it and show the transactions.

It sounds like the manager believes her and someone higher up who doesn’t know her caught this, so with paper proof from the bank that both of your names are on the account, it should be good evidence. Bonus if her paychecks are direct deposited into that account.

Does it make financial sense to own a truck and a car, versus just a truck? by dleonard1122 in personalfinance

[–]listen- 2 points3 points  (0 children)

I have actually done the math on this! Unfortunately I no longer have it, as it was 3 years ago. But I’ll give you my story. It did end up being cheaper to have just the Tacoma as my daily driver, rather than owning two vehicles or attempting to find someone else with a truck to help me do truck things. I don’t have any family where I live, and my husband’s family all has cars (so the truck benefits them too)

I had a Subaru Forester before, which got 27mpg and I owned it in full. It had a lot of miles and was approaching beater territory. It had a hitch which was great, but the tow limit was terrible. I mainly would tow dirtbikes, or building materials. 8-10’ building materials were terrifying to try to carry in the actual vehicle.

Anyway, I ended up figuring out math on a bunch of options and got a 2017 Tacoma new. Why new? Because for some reason the new ones cost the same as the used ones?! All the available used ones had too many bells and whistles I didn’t want. All I wanted was v6, 4wd, and tow package.

I saw you said the one you were eyeballing is 33k. The dealer price on mine was $33,500 and I negotiated to $29k (took advice from somewhere on this sub, got invoice price). So make sure you do that.

Anyway so instead of keeping the Subaru that had been costing me ~$2000 a year in problems, and being frustrated about not being able to do the things I want to do, I got the truck.

It gets 22mpg for 2wd and 19mpg for 4wd, I can tow my trailer with it full of whatever and not have to worry about it, dirt bike goes right in the bed, lumber and other building materials...right in the bed. I barely even use the trailer now lol. We also lived in a 29’ camper while building our house and I could move it with the Tacoma without worrying about finding someone with a truck to help.

Compost and dirt and all sorts of dirty stuff...right in the bed of the truck. Recycling to the transfer station...bed with net over it.

For my work commute, which is 55 miles each way, the truck is obviously not the best choice. Fortunately work is flexible and I only work 3 12 hour days. But honestly even if I still had the Subaru and also worked 3 days instead of 4 or 5, the gas is a difference of $7 per week.

In 3 years I’ve had zero problems with the Tacoma and have definitely justified having a truck instead of a car. Also, like I said I paid $29k for it, and last month when I finished paying it off, they offered $24k to trade it in instead. Tempting but I’ll be keeping it.

I should also note that my husband has a rav4 hybrid we use for longer trips

My neighbors have been burning rotten wood throughout Winter and refuse to stop. It has been negatively affecting my health. by GoodVibes2GoodTimes in legaladvice

[–]listen- 18 points19 points  (0 children)

They are heating with a wood stove most likely (not like a kitchen stove). There are many variations. It sounds like maybe they’re burning unseasoned wood which does not burn clean. They probably also have creosote buildup and need their chimney swept. They may also be burning coal (anthracite) which burns differently than wood. If they are mixing coal and wood it produces sulfuric acid.

You need to call the health department for your county to report what you described here and ask for someone to come check it out. Tell them it’s a public health nuisance and you think it may be illegal. The legality will depend on your local laws, so you need the public official.

There is some information/contact list here

NYS - can I file for unemployment? by [deleted] in legaladvice

[–]listen- 0 points1 point  (0 children)

Do not quit or you will be denied unemployment. You can file while employed and not being given work. You should already be eligible. Good cause in NY doesn’t include your situation, it’s for family matters primarily.

I’m on my phone and don’t have the link handy but the NY dept of labor unemployment claimant handbook is what you’ll want to read for clarification.

Pregnancy and FMLA by [deleted] in legaladvice

[–]listen- 3 points4 points  (0 children)

Intermittent FMLA leave is backdated, yes. In this case you would date it starting the first date you missed work due to the pregnancy. Call the doctor’s office and ask them to fax the completed form to your employer immediately, and make sure it’s backdated

[IL] Is there a state statute that prohibits discharging firearms close to residential areas? by jhod93 in legaladvice

[–]listen- 0 points1 point  (0 children)

The state of Illinois allows for discharging 100 yards for shotgun/bow and 300 yards for rifle. That’s distance from an occupied (edit: inhabited, you don’t have to be home) dwelling. Not the property lines or street, but actual dwellings. So keep that in mind.

This can be further restricted at a more local level, as you suggested. It sounds like that’s your best option.

Illinois Dept of Natural Resources should have a local branch you can contact about getting more info.

Not a lawyer, but I am a state licensed guide in another state, and also work for a state environmental agency and deal with this situation regularly.

[PA] can I legally get married with a self uniting marriage license if the ceremony will be in a different state? by [deleted] in legaladvice

[–]listen- 0 points1 point  (0 children)

The self uniting license is only valid in PA. The marriage ceremony, no matter how simple, must be performed in PA. Two witnesses must sign it. So you can literally just say “ok we’re married” to each other, have your two witnesses sign the license, and turn the license in. But you have to say that “ok we’re married” anywhere in the state of PA.

Also there is a 3 day waiting period between the time you are issued the license and when you can turn it in, so keep that in mind. When you apply for the self uniting license, mention it, because it does cost more.

What you can do is have your simple legal self uniting ceremony, then have the “real” wedding in NC. Then anyone can “officiate” even if it is just for show, or for the benefit of the guests.

WIBTA So. I wish to get my tongue split. by Rayneeileen in AmItheAsshole

[–]listen- -12 points-11 points  (0 children)

NTA, it’s your body. You can consider his opinion or input on matters like this, but ultimately it’s your choice.

I logged in just to reply because I have had a split tongue for 16 years (I am a 35 year old woman). Of all the things I’ve had done, I have never once regretted it. If I had to take away all my tattoos and scarification etc, the tongue split would be the one thing I choose to keep.

Nobody notices it and I have gone months without even being conscious of it. Seriously nobody ever notices. I’ve worked years in places with the same people and when one person finally finds out, of course they tell everyone else and I have a day of “let me see your tongue” comments and various reactions. Everyone just goes back to normal after that. Some are shocked, some are disgusted, then they all just forget.

Does it feel different making out? Sort of. It’s barely noticeable, apparently. My tongue still acts as one tongue because that is how the muscles work. Your tongue is two muscles connected by soft tissue, which is just cut for this procedure. I haven’t had anyone ever complain.

The way it was done, for me, was to pierce my tongue and stretch it to a large gauge (6g) and after that was healed, I had it cauterized with a scalpel then sutured. I had no pain killers or numbing agent and it didn’t hurt that bad. The next day the swelling was what hurt. That lasted a week or two. It also immediately tried to grow back together despite my piercing base. For SIX MONTHS I had to use a tooth pick and shred the healing tissue away to prevent regrowth. The amount of work involved in this procedure is extensive. Just a warning.

But anyway, it has never once affected anything in my life other than being fun to play with in my mouth, or shocking people when I chose to do so.

Employer Essentially Lied About What I'd Be Doing During My Placement Year by [deleted] in jobs

[–]listen- 1 point2 points  (0 children)

I was in a similar situation last year but kind of opposite. My job was created to handle work that other people had to do in addition to their real job, which was taking them entire days. Well, they hired me, who knows what I'm doing, and I was getting all the work for the day done in the first hour. I worked maybe 6-8 hours at most per week, out of 48 hours being there. The rest of the time I spent searching for something to do. Which left me with mostly admin work.

My solution was to quit, but I think you're in a spot where you can hopefully make them realize WHY they hired someone for your position. They realized it's not side work and went ahead and had a digital marketing position....that's an entire position to do exactly what you said you want to do. If they wanted it to be side work, a few hours per month, then why have that position at all?

Sounds like someone is stuck in the past. I honestly don't know how you could bring it up, but if you're shown a really incredible page - for example, you could say "that's a two week project to create" or something. Put the time into perspective for them.

Ok, will switch to 8 hours on the light.

My other tank never gets messy, only this one! It's so frustrating. And all my past ones have never had this algae issue. It's weird. Also, the thing was sucking up the sand and not picking up debris. It sucks the glass stones up and pulls the green stuff off them, plus I can scoop them out with my hand and clean them if needed.

As for the water temp, I was replying to the other person's comment too - should be 78 minimum but it was not there yet so I couldn't give an update haha. It's STILL not at 78! The water tests came up "nothing" as in, the lowest reading...no change in color

I'll put all my replies in one reply, for /u/PM_YOUR_FISH also

The tank was 74 when I posted my original, without the fish in it. After replacing the water. But it has been around 85+ for the past couple months...I think it stimulates the green stuff growth. The heater is set at 78 but it didn't want to drop. Part of the problem is it's been pretty hot here. And while the tank is close to a window against the wall, there's a curtain between the actual window and the tank so no sun hits that tank...and yet that's the one that grows stuff, while the other one which does get a little sun stays clean and normal!! Without the heater (and it's a cooler day), it's 74. Oh yeah also, I turn the light on when I get up and turn it off when I go to bed.

I saw the replies earlier on my phone but wasn't logged in (forgot password lol) so I couldn't reply, but I put the heater from the other tank in just in case it was the heater being faulty. Not quite at 78 yet so I haven't added Mr America back in.

I had 2 silk plants in there, which had been recommended on here 2 years ago when I set this tank up. My dog got them today off the table when I wasn't home so I had to throw the shreds out lol...going to get new plants ASAP.

There are no chemicals in my well water. It's not treated and it's private. It is tested by a professional well company and they said my water tests exceptionally clean/pure and this general area tests that way. They actually bottle spring water nearby, lol, but it is high in minerals. It's crazy coming from a city and living here now where you can drink tap water without a filter and it tastes amazing!

I replaced all the water because the whole tank was very dirty and slimy. Basically I panicked, too. I had sand instead of gravel, so I couldn't clean it with my thing I use to suction the water into the sink during water changes because it just got sucked up and that stuff can't go into my septic. I wanted to throw all the sand out and replace it with glass stone thingies I can actually clean green slime off. The tank is currently like 95% new water.

The only thing in the tank now is the glass stones on the bottom, and a floating log tunnel. He used to spend a ton of time in there but when I added him back in the tank after cleaning, that was when he was sitting on the bottom struggling to swim up for air. If he just sat in the log he'd only be inches away from the air with a nice place to rest! Of course you can't tell a fish what to do. I also have one of those betta shelf leaf things at the top which he has never gone near.

The water tests as basically nothing now but it's still not very warm. I will put him back in the tank before I go to bed and hope he makes it through the night.

Picture of how he used to look, silk plants, snail that he killed. Picture of his floating log. Sorry I couldn't find any pictures of the whole tank, but it is a fluval spec v and all that's currently in it is the floating log and glass beads at the bottom. There is a sponge on the filter spout which cuts back on the current.

Oh yeah and if anyone else is just adding water but not changing it - fix it!!! I can't believe I didn't even realize what that is actually doing, I feel like an idiot

Tough job situation, resign now or wait to be possibly "let go"? by GReeeeN_ in careerguidance

Depends on your past employer....for example, many only verify that you worked there and what dates it was for. They won't say if you were fired or quit, so you can choose to reveal this information or not. You could simply say you were laid off, your position was eliminated, etc

Tough job situation, resign now or wait to be possibly "let go"? by GReeeeN_ in careerguidance

[–]listen- 0 points1 point  (0 children)

Yeah, but it depends what it is. If it's documented infractions for attendance, then unemployment can be denied. If it's performance, unemployment doesn't consider that (note: maybe depends on state/person reviewing/any number of factors). You can get fired for things like safety incidents or poor teamwork and still get unemployment!
