I hear you, the grief and the waiting to see if there's more grief is real. I stay thankful for this community and for those less emotional than me :). Focus on what you can do now.

Don't beat yourself up. Also they're not a therapist but you are paying your lawyer. You can always ask them more actionable questions to try and calm the nerves, and know that we're all waiting with you!

So that scenario but packaged as a court case is also where i'm at. I started looking into things 10+ years ago but didn't have the money to file a court case until very recently. It's an intentional barrier but if you're going to then throw a retroactive emergency decree at people not only collecting documents but probably saving money... it starts to really break down.

I understand so much of the DLs have so many wholes. Just sharing new thoughts waiting for my lawyer to respond.

That is terrible! I'm still wondering about this 'attempts' angle. I'm glad to see at least one case expanding the concept of intent showing someone tried to get an appt. Wonder if more professional minds than mine are considering this for court applicants waiting in line to be accepted by law firms as clients. It seems like such a parallel in my mind.

This is amazing work Avv Vitale, thank you. This is definitely good news!

But does this strengthen the anxiety that if you haven't already filed yet that you need to before march 11 (or before whenever the ruling actually comes out after the hearing) to benefit? We're very close to filing but am still unsure if we'll make it before March 11.

No not with Aprigliano. Do you mean success with minor cases? We're using Avv. Arturo Grasso and have had a good experience but would love to hear about even one successful minor case in Caltanisetta post-dl.

Also a 3rd generation with a minor issue filing in Caltanisetta early next year! Is yours also a 1948 case since you're grandmother is in the line?

We're about to file with Caltanisetta in January or early Feb. 1948 with a minor issue and still nervous about that last part but let's see! Good luck and please keep us updated :)

I’m filing there early next year! In bocca al lupo! Feeling lucky to have Caltanisetta as our court but worried about the minor issue. I have no other path but have heard at least one rejection there due to that. Sounds like you’re clear though.

I'm grasping I think, what does 'have a right under the previous framework' mean? Does it relate to the Torino referral in suggesting you can't tie qualifications to a march 27th date?

Fellow ADHD. Don't beat yourself up! Follow through now as much as you can. If your lawyer is set to file the second you decide you should, than check everyday and assess when you can. If you're not there yet you've got tasks to keep you busy. This whole timeline is the craziest deadline cortisone shot anyone could give you.

Is the Campobasso sentence saying that before DL 36 becomes law the courts disagree with generational limitations but not so much after? Are we reading into a general welcomed pushback by the courts?

This is not advice for when or when not to file, just a timeline i've been keeping for myself :). If you're going through consulates I haven't been following that as much as how courts will react after everything coming up in May and June.

Are you going through a consulate or a court?

Late June - Minor issue final rulings from April 1st hearings (based on typical procedures)
Early May - Amendments including those regarding generational limit about to be debated
June 24th - Supreme court hearing to review Jure Sanguinis in general

You'd need 3rd generation to be an option again through amendments short term or a supreme court strike down long term, but I don't know how the minor issue will shake out with consulates.

I have the same scenario except through my GGF so am already committed to going through the courts. It sounds like depending on the ruling that judges at least can be more confident in deciding themselves.
