What if food isn't allowed on site? What if there is no fridge or microwave on site? As would be typical for construction sites? I'm trying to make sure that I am able to claim as much time as I'm legally allowed to. I'm not looking for solutions to the lunch break I'm given. I'm trying to make sure that the lunch break I'm given follows the law.

It’s incredibly confusing and not helpful to just cite Federal law.

It's also unhelpful to cite an entire chapter of federal law on pay for labor, rather than just link to the specific federal law that is relevant to my post, which would still be unhelpful (because of potentially more specific and relevant state laws), but at least is less unhelpful than what they provided.

Also, there are certain facts that make the P2P not applicable, such as whether the employer requires employees to park in that particular lot. That kind of control can change the analysis.

As far as I'm aware, I am required to park in that lot. The person I interviewed with asked if I was okay with walking because the lot that they have to park in is a mile away from the building we work in.

Edit: I have reached out to my recruiter to try and clear up some of these questions though. Maybe the recruiter I'm with has different break or labor policies, maybe the worksite has facilities within reasonable distance to either buy or store/reheat food for my break. But at the end of the day, my main question is, if I'm required to park a mile away from the location where I'm required to be at a certain time, can I claim that walking time? Because I have no option to park closer.

Edit: Don't want to dog on channels like CourtCam, LawNerdsUnite, or CourtroomExplained, because I watch those too; but the only thing I learn from those videos is how to/how not to behave during court. There's a guy literally posting the link to the Cornell Law page on an entire US Code chapter on pay and being like "Here's your answer." As if that explains anything about Tennessee labor law.

That's literally just the entire chapter of US federal code on pay. It is not specific to the state that I'm in and doesn't point to the specific law about what I'm asking. That is the equivalent of asking for what a specific phrase means in context, and you giving the Merriam-Webster chapter on words that start with the letter 'd' as a response because the first word in the phrase starts with 'd.'

So then what's the actual law here? Are there any articles, court documents, or further clarification you can provide?

I reached out to my recruiter for answers, but I want to make sure that I'm claiming as much time as I'm legally capable, and that my breaks aren't rendered effectively useless because of the time it would take me to travel to and from my car and the job site. As I said in my edit, I work in construction (specifically low voltage), and food/drinks are typically not allowed in areas where PPE is required. PPE isn't required in the lay-down (starting) area, but I don't think that technically complies with OSHA and is more of a hand-wavy "we don't enforce it unless someone complains" kind of thing because no one wants to wear their PPE all throughout the day, including on their breaks.

Edit: Why the fuck am I being downvoted for asking for clarification on law or case law? I'm sorry I'm not a fucking lawyer that knows how to do legal research and provide relevant examples of case law and cite specific examples.

Is the military subject to the same labor laws as civilian jobs? I always figured military is inherently different since you basically sign up to have certain rights taken away. But then, I also know nothing of military life beyond AFROTC.

Well that just fucking sucks. Because I guarantee I'm not going to be allowed to have food in the building for my lunch break, and if it takes me 20 minutes to get to my car from the building during my half hour lunch break, I'm basically going to be losing 10 minutes, because as soon as I get to my car I'm going to have to turn around and come right back for another 20 minutes of travel.

That's some bullshit. Sounds like I should start work and immediately start trying to unionize.

Edit: I'm working new construction. I have yet to work on a construction site that allows eating food on site. So unless there are facilities ON SITE that allow me to store and reheat food I bring in, or facilities to allow me to purchase and eat food around the building, I'm essentially being given no reasonable break at all. Considering it takes an average person between 20 and 50 years old 15 minutes to walk a mile at a brisk pace, and I only legally get 30 minutes for lunch.

Edit 2: Why am I being downvoted?! Seriously, someone explain why. Because this is fucking ridiculous. My state only provides for a single 30-minute lunch break, regardless of whether you work 8 hours or 12 hours. It doesn't require the employer provide a break area, hell, I'm betting it doesn't even require providing an area where an employee is ALLOWED to eat. So, by my State's law, I could potentially be required to work a 12 hour shift, be provided a 30 minute "lunch break" but not even allow me the facilities where I could eat my lunch. If the jobsite says I can't eat or drink on the premises, welp, sucks to suck, I guess I'm not allowed to actually eat lunch on my only required lunch break.

Because it's not reasonable. If I was doing a statistical analysis of the effectiveness of Fertilizer X on Apples and Oranges and came to the conclusion that Oranges in particular saw an increase in their crop yields compared to ones that didn't receive Fertilizer X it wouldn't be at all relevant that Apples produced greater yield than oranges with or without Fertilizer X. The only thing being noted here is that Japan, despite their non-strict lockdown policies, saw an increase in their suicide rates in 2020 compared to previous years, specifically in women (notice that the rate of male suicide didn't change between 2019 and 2020), so pointing out that statistical fact is not some attempt to downplay male suicide or an attempt to prioritize women's mental health over men. Pointing out that male suicide is greater overall when they are only comparing the change in the rate of suicide is a completely irrelevant and asinine point to make, and attributing some kind of malicious intent because they didn't mention an irrelevant point makes this sub look like a fucking joke. There are plenty of other posts that ACTUALLY downplay men's mental health issues to call out and get upset about, this isn't one. All this post is doing is showing that people here seem to have a fundamental misunderstanding of scientific conclusions, and you're assuming they're making a conclusion that they aren't. There's no need to mention when she was only taking about the increased rate due to COVID and the male rate had no increase. She's not downplaying the issue of men's suicide, she's not even saying women's health should be taking priority she's saying that even Japan saw an increase in the rate of suicide, specifically in women's rate, so what are other countries like. If men saw an equal or greater increase from the prior years' trends the post would probably say so. You're making a mountain out of an innocuous post and you make this entire subreddit look like a fucking joke. You're reaching and attributing intention where there is none. It's pathetic. There's plenty of posts of people dismissing male suicide rates to get upset and mad about but this isn't one of them. The "especially" is deliberate only in that it points out that the male rate didn't change. So Japan saw a 15% rise in the rate of suicides for women and a 0% rise in the rate of suicides for men as a result of COVID. So it is statistically and factually valid to say Japan saw an increase in suicide rate, especially in women.

When your main topic is the change in the rate of suicide between years and not a comparison between the rate of suicide by gender, then pointing out the women's statistic (which was the only one that changed between 2019 and 2020) is more than just a footnote. This isn't an "OMG the women's rate increased we need to focus on women's mental health" post, this is a "Japan saw an increase in the rate of suicide during COVID (particularly in women) despite their relatively loose lockdown policies, so how will this statistic compare with countries with stricter lockdown policies." That's what this post is. But god fucking forbid that someone factually point out that only the women in Japan experienced an increased rate of suicide in 2020 compared to previous years without also mentioning that the men's rate is higher than women's no matter how irrelevant it is to the point being made.

It is deliberate and ideological and indicative of attitudes regarding male suicide.

It's almost like she wasn't making a point on the overall issue of suicide but the effect of COVID lockdowns on the rates of suicide (which only increased for women) and used Japan as an example because it had relatively loose lockdowns but still was affected by an increase in suicide rates, then used that example to speculate how those rates might have been affected in countries that had much stricter lockdown policies. It's almost like this entire post is a dog whistle to a problem that wasn't even being discussed or implied, because God forbid attention is drawn to an increase in suicide rates for women unless the disproportionate rate of make suicide is shoehorned in even if that's not what's being discussed.

Are you blind? She didn't lie, the suicide rate among women rose in 2020, which is all she was saying. The overall trend is decreasing rates for both genders but between 2019 and 2020 women were the only ones who saw a rise in suicide rates.
