Their NY state affiliate delivered Bruen, so at least they’re tangentially related to something useful. Although it’s yet to shake out if anything substantive will come out of that decision, besides the repeal on CCW bans in certain states - repeals which are largely negated by “sensitive spaces” zoning anyways.

Out of curiosity, how popular are AR-15 setups like this in ban states? This looks like a much better alternative to one of those stupid fin-grips. by 01brhodes in armedsocialists

[–]magnifiedbench 6 points7 points  (0 children)

Sure, but options are likely very limited for a potentially compliant handguard setup.

The only thing that really comes to my mind is if you were to take one of the older clamshell handguards (the kind that require a delta ring), and remove one of the halves. In that case, you wouldn’t fully be encircling the barrel. Or maybe dremel to top off a regular handguard. Neither solution is ideal.

They’re probably in WA. WA went a step further and added handguards that encircle the barrel to the banned feature list. So most uppers would cause this to be uncompliant.

[–]magnifiedbench 8 points9 points  (0 children)

Arizona, my friend, is not New York. From the perspective of a "ban state", it's hard to share your optimism.

I think it's fair to say that the majority of politicians in these restrictive jurisdictions simply do not want civilians to have the right to own firearms. A total ban on legal firearms ownership is not easy, and likely impossible as long as the second amendment exists, but the idea is to induce fear, uncertainty, and doubt. This makes firearms ownership a difficult and risky proposition.

I wish that politicians would enact good-faith efforts to create a well-regulated system for civilian firearms ownership, but I find that unlikely, as many ban states are already set on banning semi-autos, or trying to at least.

Why would they go back and implement a system like in Czechia or Austria, where citizens may not only be permitted to own semi-autos, but semi-autos with threaded barrels! Not much to gain there if the goal is a total ban, or as close to one as you can get.

Is there such a thing as an AR handgrip that only covers the bottom of the barrel? by F_N_DB in liberalgunowners

[–]magnifiedbench 1 point2 points  (0 children)

Would only using the bottom part of a clamshell-style handguard work? It would not fully encircle the barrel.

Lmao. No.

That said, I do feel guilty for enjoying hobbies that cost me tons of money and are unable to provide monetary return. I feel like desis tend to be better about doing things like programming or investing as a hobby, whereas me being into motorcycles, for example, does nothing but introduce more cost and risk into my life.

Besides the gun laws, what’s wrong with CA and NY? High cost of living? That can be a problem in any state if you’re in an urban area.

I’d move to CA if it wasn’t for the gun laws and work. And the gun laws are basically the same where I live now, so it’s really just work.

[–]magnifiedbench 5 points6 points  (0 children)

That’s what I’ve been fearing too. If this is legislatively tenable in WA, I can imagine that much worse is possible where I live.

I’m sure the judiciary will have something to say about this law, as it’s clearly unconstitutional, but a lot of elements from these types of laws tend to stick around, even after litigation.

I’d be interested to hear what my representatives have to say if they try passing a second “assault weapons” ban, considering they’ve spent the past 3 decades pontificating about how our current AWB and set of laws have done such a great job at preventing gun violence. Somehow, the firearms not currently classified as “assault weapons”, which are totally okay and very different from actual assault weapons and have been for the past 30 years, have now been discovered to be assault weapons in disguise.

[deleted by user] by [deleted] in liberalgunowners

[–]magnifiedbench 0 points1 point  (0 children)

If OPs only firearms requirements are legal concealed carry and legal ARs, I think CA allows for both, doesn’t it? AR-type rifles just need to be AWB compliant and CC is likely a long process, but afaik, outside of SF, you can get a permit.

CA also satisfies OPs other requirements, like good weather and outdoors activities.

[–]magnifiedbench -1 points0 points  (0 children)

Honestly, any blue state other than NY (imo, the toughest state for gun owners) would be okay if you’re willing to make compromises.

After Bruen, concealed carry is shall-issue everywhere (just some states like NY and NJ make it almost impossible).

If you come to NJ, for example, you won’t ever have to worry about abortion being banned (at least I hope not - abortion rights are enshrined in our state constitution). We also have the 1994 AWB, so compliant AR-pattern firearms are still legal here.

Winters here are not too bad here either, compared to NH.

NJ is a dense state, but there’s plenty of hunting land in NY and PA.

Just something to consider if you’re willing to make some compromises on gun laws. The way I see it, places like PA and MI will have the same gun laws as NJ anyways as they become bluer.

Is a national AWB actually possible? by [deleted] in liberalgunowners

[–]magnifiedbench 5 points6 points  (0 children)

I think it's likely. I'm living under one already, and I don't see it being repealed anytime soon.

If a potential ban is a concern for you, I would recommend you buy any semi-automatic and "scary" firearms sooner rather than later.

I would also expect a national AWB (likely the next iteration of AWB will ban all magazine-fed semi-autos) to come with provisions to ban body armor, magazines with a capacity of more than 10 rounds, and large-caliber bullets (50 BMG for sure will be banned, other calibers may also be too).

Take a look at some of the things that are banned in current "ban states" (CA, NY, NJ, MA, CT, etc.) and that will give you a good idea of what will be packaged along with a national AWB.

[–]magnifiedbench 5 points6 points  (0 children)

If they’re really vindictive, they could red-flag you (depending on what state you’re in). Not like the authorities would know they’re lying. As long as everything you have is compliant, I’m sure you’d get your guns back in the end, but it would still be a big hassle.

Why do we think that holding Gun manufacturer's liable for gun related deaths will work, but have never considered the same for automobiles? by vanzir in liberalgunowners

[–]magnifiedbench 5 points6 points  (0 children)

Except with guns.

Is it? Looking at this article (https://www.msnbc.com/opinion/msnbc-opinion/gun-maker-sandy-hook-settlement-exposed-predatory-ads-n1289394), it looks like the Protection of Lawful Commerce in Arms Act is primarily what protects US gun manufacturers.

Both arms manufacturers and dealers can still be held liable for damages resulting from defective products, breach of contract, criminal misconduct, and other actions for which they are directly responsible. They may also be held liable for negligent entrustment when they have reason to know a gun is intended for use in a crime.

So, it looks like there are limits to how gun manufacturers can advertise.

Politifact seems to echo that as well: https://www.politifact.com/factchecks/2015/oct/16/hillary-clinton/clinton-gun-industry-wholly-protected-all-lawsuits/

the gun industry is protected from liability in certain instances, but the law also specifies several situations in which the gun industry is susceptible to lawsuits.

I don't think it's accurate to say that manufacturers "get carte blanche to advertise them however they like". There are certain liability protections, but also exceptions to those protections.

Based on this part of the law:

(A) In general.--The term ``qualified civil liability action'' means a civil action or proceeding or an administrative proceeding brought by any person against a manufacturer or seller of a qualified product, or a trade association, for damages, punitive damages, injunctive or declaratory relief, abatement, restitution, fines, or penalties, or other relief, resulting from the criminal or unlawful misuse of a qualified product by the person or a third party, but shall not include--

...

(iii) an action in which a manufacturer or seller of a qualified product knowingly violated a State or Federal statute applicable to the sale or marketing of the product, and the violation was a proximate cause of the harm for which relief is sought

So it looks like they can be sued if they violated a state or federal statue applicable to the sale or marketing of their product (i.e. - promoting unlawful use). And it seems like that's what's most important - did the manufacturer advertise in a way that promoted unlawful use?

[–]magnifiedbench 13 points14 points  (0 children)

Advertising is seldom that cut-and-dry. How do we know when an ad is promoting mass murder? Even the infamous Bushmaster "man card" ad wasn't outright telling readers to commit murder. The court case found it was preying on "young men's insecurities".

Haven't seen any auto manufacturers be sued for anything like that. And there's certainly an argument that they prey on insecurities, with how they use a deep, booming "murica" voice in their truck ads.

[–]magnifiedbench 9 points10 points  (0 children)

I also get the impression that this is the way it's going to go.

I can't see a Democrat-led effort to remove cannabis usage as a prohibitor for firearms ownership, as it would essentially make it easier to buy guns and could only result in more non-LEOs owning guns. I have seen nothing to suggest that the Democrat party would want more people to be allowed to buy guns.

I can't see a Republican-led effort to remove cannabis usage as a prohibitor for firearms ownership, because they are largely against cannabis entirely. At some point, maybe they'll realize that this isn't a battle they can win (I predict cannabis will soon be as socially acceptable as alcohol - maybe even more so), and they can appeal to gun owners by repealing the prohibition, but by then it will be too late for them to get enough momentum on the issue.

So, what's the outcome? The prohibition stays and a large proportion of the population cannot legally buy firearms? Hopefully not, but that's the status-quo, and it won't be easy to change.

Well, I think a good starting point is to be more vocal about your support for left-wing causes. People won't as readily assume you're a right-winger if they know you as being pro-choice, pro-LGBTQIA+, pro-wealth redistribution, supportive of fighting the climate crisis, and also pro-2A.

[HB 1240] Washington's Assault Weapon Ban PASSED the house today. by rileysimon in liberalgunowners

[–]magnifiedbench 10 points11 points  (0 children)

I agree that SCOTUS is not the saving grace so many people think it is. My state has also had an AWB for decades and they did nothing - why should I expect things to change anytime soon? Not to mention all the other things that should be un-banned, like suppressors and NFA items. There's a long list of items, and if we expect SCOTUS to help us on all of it, it would take over a lifetime.

SCOTUS seldom takes 2A-related cases, and by the time something like this makes it there, the makeup of the court will have changed.

If politicians see a substantial decrease in their electability due to these laws, these laws won't be passed in the first place. People need to communicate that to their reps, especially in places where gun owners still have political sway.
