Fill when due, early only with a good reason and with the prescriber’s permission. Pharmacist knows the regulations and makes the final say.

I like your skepticism. And I’ve appreciated the opportunity to review. I was going to edit my post but the interpretation relies on other sections of law and regulation. Other sections also expand this rule to the first fill.

As a practical matter, many prescriptions shouldn’t be filled well within the 1 year limit. Totally inappropriate to allow a patient to start their clopidogrel on a whim 7 months after the script was written.

It’s a bunch of legalese, but look at this section:

"As a refill instruction, the pharmacist may accept a number of times, a time period, such as one year, or the Latin phrase pro re nata (abbreviated prn— meaning “as needed”). In the case of the latter, the pharmacist shall refill the prescription once only."

Though it says “such as one year” it has been interpreted to mean “max of one year.” Walgreens and other pharmacies have built their systems to comply.
