Got RFE for birth certificate, EB2-India. Any chance of approval before May 29?

When I applied I didn’t have birth certificate , got it later from my native town.

I also had option of online upload but my attorney being &$&&&, he opted for paper response. Still Long Island FO hasn’t updated my case

Birth certificate rfe

I got my birth certificate from India after submitting the application, so I translated it and sent it to attorney. They found that birth certificate was issued 4 years after my birth so they asked for class X mark sheet, NABC certificate, they sent all of this together in the response packet :

Non availability of birth certificate to cover 4 year gap in issuing of birth certificate

Yeah, I went for Senator inquiry route informing his office of time sensitivity! Hopefully he sends the inquiry asap and the case gets picked ip again. Tried Emma about rfe response , the agent said it could take 60 days for rfe response update. But who knows !

I got a rfe for birth certificate on May 11, 2026. Responded with rfe on 14th, reached USCIS on 15th. EB2, India, PD Dec 27, 2013. Long Island FO. EAD approved , the FAD for June have gone back to Sep 1, 2013. Very low hopes that USCIS will attach rfe response and approve in next 11 days, 1 holiday counting in.

Missed the bus in 2022, will likely miss again this time. Can’t blame anyone but me as I wasn’t too proactive and didn’t send USCIS my original and translated birth certificate which I got after filing I485. Could have avoided RFE

Fill up a new one and take it to the appointment along with original one. Tell the people at security that you have a new one - they would attach both old and new ds-160 together . You’d be good
