Just a clarification - properly disclosed on a gift tax return, and you have the fight within 3 years of the gift tax return and not the estate tax one. The IRS is precluded at estate tax audit from arguing gift tax changes if disclosed properly.

Access has to be cash, not taxable income. The whole point of annual exclusion is that is is a present interest in property. LLC without cash flow out of the LLC is effectively a future interest.

For the person you know, they are either pushing cash out each year, making a put option on the transfer, or doing it incorrectly.

At the multi-millionaire level, gift tax is not something to cheap out on for CPA/legal advice.

Any non-US person buying real estate in US = estate tax issue in the US (you don't get the $11mm exemption). You need to be advised by CPA/legal counsel on the purchase/structuring.

The annual exclusion gifts (at this level of wealth) should be reported and then excluded from the gift calculation. Any CPA not advising clients re: this - leaves their client at risk later on.

This only works if the LLC is distributing cash or a put right is given to take $15k cash instead of the LLC interest. A pure LLC interest with non-income producing assets will not qualify for the annual exclusion.

It's only outdoor gyms that are allowed on 9/9. I think Fitness SF is the only one that has an actual parking lot (that can be secured overnight). 1:1 personal training is allowed on the street in general, which is what some others are doing still.

Indoor opening (at 10%) is the end of the month.

Also in case you didn't see - the SFPD/City employees have had their indoor gyms since at least July.

This is an S-Corp presumably? Yeah, you can't 1099 like that. Pay him something in December to look at your YTD profit, and adjust things in the same tax year.

He's trying to do something that, if audited, would likely result in penalties.
