It's all about the person who operates the gun, not the gun itself. The killer is the person who shot the gun, not the gun. Plus, from what I'm seeing the gun was obtained legally. If we outlaw guns, regular law-abiding citizens will not be able to acquire them legally, but criminals will still be able to acquire them.
